Other changes relating to enforcement

Execution of works required by enforcement notice10.

(1)

For Article 74(1) of the principal Order (power to execute works required by enforcement notice) there is substituted—

“(1)

Where any steps required by an enforcement notice to be taken are not taken within the period allowed for compliance with the notice, a person authorised in writing by the Department may—

(a)

enter the land and take the steps; and

(b)

recover from the person who is then the owner of the land any expenses reasonably incurred by it in doing so and those expenses shall be a civil debt recoverable summarily.”.

(2)

After paragraph (8) of that Article there is added—

“(9)

Any person who wilfully obstructs a person acting in the exercise of powers under paragraph (1) shall be guilty of an offence and liable on summary conviction to a fine not exceeding level 3 on the standard scale.”.
