This Part applies to a formal investigation which the Commission has decided or has been directed to conduct.

Anysubsequent action required or authorised by this Part (or by Part IV) to be taken by the Commission in relation to the conduct of a formal investigation may be taken, so far as they are authorised to do so, by persons nominated under Article 5(5) for the purposes of the investigation.
