Application of other enactments41
The duties in sections36 and 38(2)(a) do not apply to the extent that—
(a)
the listed authority lacks necessary powers (other than by virtue of this Act) to ensure compliance with the duties, or
(b)
the duties are inconsistent with any other statutory provision.
