271Assisting breach of community residence requirement

A person commits an offence if—

a

the person knows that another person (“P”) is required by a community residence requirement to live at a particular place; and

b

the person induces, or intentionally assists, P to stop living at that place.

A person commits an offence if—

a

the person knows that another person (“P”) is required by a community residence requirement to live at a particular place;

b

P has stopped living at that place; and

c

the person gives P any assistance with the intention of preventing, delaying or interfering with P's being returned to live at that place.

A person guilty of an offence under this section is liable—

a

on summary conviction, to imprisonment for a term not exceeding 6 months or a fine not exceeding the statutory maximum or both;

b

on conviction on indictment, to imprisonment for a term not exceeding 2 years or a fine or both.

In this section “community residence requirement” means a community residence requirement (as defined by section 31) that is imposed under Part 2.
