Commentary on Sections

Existing schemes: supplementary

Section 28: Existing local government schemes

Section 28 provides for certain regulations made under Article 9 of the Superannuation (Northern Ireland) Order 1972 to have effect as if they were scheme regulations made under section 1 of the Act. This section will only apply to regulations under which benefits are provided to or in respect of service on or after 1st April 2015. It will only apply to regulations that provide for pension benefits in respect of service on or after that date. The section provides that such regulations have effect as if they were scheme regulations for local government workers to the extent that they could have been made under the Act.

Section 29: Existing schemes for civil servants: extension of access

This section introduces Schedule 9, which amends the Superannuation (Northern Ireland) Order 1972 to extend access to schemes made under Article 3 of that Order.

Section 30: Police pensions

This section revokes regulations C9 and C9A of the Royal Ulster Constabulary Pension Regulations (Northern Ireland) 1988 which provide for the termination of pensions payable to police widows, etc. on remarriage or other similar events. Pensions terminated by virtue of the regulations are re-instated and become payable from 1 July 2014.
