The power to allow the Department to correct errors in its decision documents/notices was introduced by The Planning Reform (NI) Order 2006 (No. 1252 NI 7). power has now been amended by the current Act. Firstly, the power to correct errors is now transferred to councils and secondly, the requirement to first obtain the written consent of the applicant (or the landowner if that is not the applicant) has been removed. The section also allows a council to correct an error if requested in writing by any person and if it sends a written statement to the applicant explaining the error and stating that it intends to make a correction.
Under this section a council must, after making any correction or deciding not to make any correction, issue a notice in writing specifying the correction of the error or giving notice of its decision not to correct the error.
