RestrictStartDate="2015-04-01"><Number><CommentaryRef Ref="key-007a65b417cd94f6c4e07e3be85538f9"/><Strong><CommentaryRef Ref="c21959471"/><CommentaryRef Ref="c21959481"/>PART 1</Strong></Number><Title>CONTRACTS OF COUNCILS</Title><Pblock DocumentURI="http://www.legislation.gov.uk/nia/2010/7/part/1/crossheading/contracts-for-provision-of-assets-or-services" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/part/1/crossheading/contracts-for-provision-of-assets-or-services" NumberOfProvisions="1" id="part-1-crossheading-contracts-for-provision-of-assets-or-services" RestrictStartDate="2015-04-01"><Title><Emphasis>Contracts for provision of assets or services</Emphasis></Title><P1group RestrictStartDate="2015-04-01"><Title>Functions to include power to enter contracts</Title><P1 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/1" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/1" id="section-1"><Pnumber PuncAfter=""><CommentaryRef Ref="key-56f81d67e31090cd5f6c7f2428a0fb2d"/>1</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/1/1" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/1/1" id="section-1-1"><Pnumber>1</Pnumber><P2para><Text>Every statutory provision conferring or imposing a function on a district council confers power on the district council to enter into a contract with another person for the provision or making available of assets or services, or both, for the purposes of, or in connection with, the discharge of the function by the district council.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/1/2" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/1/2" id="section-1-2"><Pnumber>2</Pnumber><P2para><Text>Where—</Text><P3 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/1/2/a" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/1/2/a" id="section-1-2-a"><Pnumber>a</Pnumber><P3para><Text>a district council enters into a contract such as is mentioned in subsection (1) (“<Term id="term-the-provision-contract">the provision contract</Term>”) under any statutory provision, and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/1/2/b" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/1/2/b" id="section-1-2-b"><Pnumber>b</Pnumber><P3para><Text>in connection with the provision contract, a person (“<Term id="term-the-financier">the financier</Term>”) makes a loan to, or provides any other form of finance for, a party to the provision contract other than the district council,</Text></P3para></P3><Text>the statutory provision also confers power on the district council to enter into a contract with the financier, or any insurer of or trustee for the financier, in connection with the provision contract.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/1/3" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/1/3" id="section-1-3"><Pnumber>3</Pnumber><P2para><Text>A provision of this Part does not apply to a contract which a district council enters into before the commencement of that provision.</Text></P2para></P2></P1para></P1></P1group></Pblock><Pblock DocumentURI="http://www.legislation.gov.uk/nia/2010/7/part/1/crossheading/certified-contracts" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/part/1/crossheading/certified-contracts" NumberOfProvisions="7" id="part-1-crossheading-certified-contracts" RestrictStartDate="2015-04-01"><Title><Emphasis>Certified contracts</Emphasis></Title><P1group RestrictExtent="N.I." RestrictStartDate="2015-04-01"><Title>Certified contracts to be intra vires</Title><P1 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/2" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/2" id="section-2"><Pnumber PuncAfter=""><CommentaryRef Ref="key-56f81d67e31090cd5f6c7f2428a0fb2d"/>2</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/2/1" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/2/1" id="section-2-1"><Pnumber>1</Pnumber><P2para><Text>Where a district council has entered into a contract, the contract shall, if it is a certified contract, have effect (and be deemed always to have had effect) as if the district council had had power to enter into it (and had exercised that power properly in entering into it).</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/2/2" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/2/2" id="section-2-2"><Pnumber>2</Pnumber><P2para><Text>For the purposes of this Part a contract entered into by a district council is a certified contract if (and, subject to subsections (3) and (4), only if) the certification requirements have been satisfied by the district council with respect to the contract and they were so satisfied before the end of the certification period.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/2/3" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/2/3" id="section-2-3"><Pnumber>3</Pnumber><P2para><Text>A contract entered into by a district council shall be treated as a certified contract during the certification period if the contract provides that the certification requirements are intended to be satisfied by the district council with respect to the contract before the end of that period.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/2/4" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/2/4" id="section-2-4"><Pnumber>4</Pnumber><P2para><Text>Where a district council has entered into a contract which is a certified contract (“<Term id="term-the-existing-contract">the existing contract</Term>”) and the existing contract is replaced by a contract entered into by it with a person or persons not identical with the person or persons with whom it entered into the existing contract, the replacement contract is also a certified contract if—</Text><P3 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/2/4/a" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/2/4/a" id="section-2-4-a"><Pnumber>a</Pnumber><P3para><Text>the period for which it operates or is intended to operate ends at the same time as the period for which the existing contract was to operate, and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/2/4/b" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/2/4/b" id="section-2-4-b"><Pnumber>b</Pnumber><P3para><Text>apart from that, its provisions are the same as those of the existing contract.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/2/5" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/2/5" id="section-2-5"><Pnumber>5</Pnumber><P2para><Text>In this Part  “<Term id="term-the-certification-period">the certification period</Term>”, in relation to a contract entered into by a district council, means the period of 6 weeks beginning with the day on which the district council entered into the contract.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/2/6" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/2/6" id="section-2-6"><Pnumber>6</Pnumber><P2para><Text>Subsection (1) is subject to section 5 (special provisions about judicial reviews <CommentaryRef Ref="key-4144bf3720a33cdd5eef922c4f9ab761"/>...).</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/2/7" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/2/7" id="section-2-7"><Pnumber>7</Pnumber><P2para><Text>The application of subsection (1) in relation to a contract entered into by a district council does not affect any claim for damages made by a person who is not (and has never been) a party to the contract in respect of a breach by the district council of any duty to do, or not to do, something before entering into the contract, including, in particular, any such duty imposed by—</Text><P3 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/2/7/a" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/2/7/a" id="section-2-7-a"><Pnumber>a</Pnumber><P3para><Text>a statutory provision for giving effect to any Community obligation relating to public procurement; or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/2/7/b" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/2/7/b" id="section-2-7-b"><Pnumber>b</Pnumber><P3para><Text>Article 19(1) of the Local Government (Miscellaneous Provisions) (Northern Ireland) Order 1992 (<Acronym Expansion="Northern Ireland">NI</Acronym> 6).</Text></P3para></P3></P2para></P2></P1para></P1></P1group><P1group ConfersPower="true" RestrictStartDate="2015-04-01"><Title>The certification requirements</Title><P1 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/3" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/3" id="section-3"><Pnumber PuncAfter=""><CommentaryRef Ref="c20282771"/><CommentaryRef Ref="key-56f81d67e31090cd5f6c7f2428a0fb2d"/>3</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/3/1" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/3/1" id="section-3-1"><Pnumber>1</Pnumber><P2para><Text>In this Part  “<Term id="term-the-certification-requirements">the certification requirements</Term>”, in relation to a contract entered into by a district council, means the requirements specified in subsections (2) to (4).</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/3/2" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/3/2" id="section-3-2"><Pnumber>2</Pnumber><P2para><Text>The requirement specified in this subsection is that the district council must have issued a certificate (whether before or after the contract is entered into)—</Text><P3 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/3/2/a" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/3/2/a" id="section-3-2-a"><Pnumber>a</Pnumber><P3para><Text>including details of the period for which the contract operates or is to operate;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/3/2/b" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/3/2/b" id="section-3-2-b"><Pnumber>b</Pnumber><P3para><Text>describing the purpose of the contract;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/3/2/c" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/3/2/c" id="section-3-2-c"><Pnumber>c</Pnumber><P3para><Text>containing a statement that the contract is or is to be a contract falling within subsection (5) or (6);</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/3/2/d" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/3/2/d" id="section-3-2-d"><Pnumber>d</Pnumber><P3para><Text>stating that the district council had or has power to enter into the contract and specifying the statutory provision, or each of the statutory provisions, conferring the power;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/3/2/e" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/3/2/e" id="section-3-2-e"><Pnumber>e</Pnumber><P3para><Text>stating that a copy of the certificate has been or is to be given to each person to whom a copy is required to be given by regulations;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/3/2/f" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/3/2/f" id="section-3-2-f"><Pnumber>f</Pnumber><P3para><Text>dealing in the prescribed manner with any matters required by regulations to be dealt with in certificates under this section; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/3/2/g" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/3/2/g" id="section-3-2-g"><Pnumber>g</Pnumber><P3para><Text>confirming that the district council has complied with or is to comply with any requirement imposed by regulations with respect to the issue of certificates under this section.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/3/3" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/3/3" id="section-3-3"><Pnumber>3</Pnumber><P2para><Text>The requirement specified in this subsection is that the district council must have secured that the certificate is signed by any person who is required by regulations to sign it.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/3/4" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/3/4" id="section-3-4"><Pnumber>4</Pnumber><P2para><Text>The requirement specified in this subsection is that the district council must have obtained consent to the issue of a certificate under this section from each of the persons with whom the district council has entered, or is to enter, into the contract.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/3/5" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/3/5" id="section-3-5"><Pnumber>5</Pnumber><P2para><Text>A contract entered into by a district council falls within this subsection if—</Text><P3 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/3/5/a" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/3/5/a" id="section-3-5-a"><Pnumber>a</Pnumber><P3para><Text>it is entered into with another person for the provision or making available of services (whether or not together with assets) for the purposes of, or in connection with, the discharge by the district council of any of its functions; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/3/5/b" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/3/5/b" id="section-3-5-b"><Pnumber>b</Pnumber><P3para><Text>it operates, or is intended to operate, for a period of at least 5 years.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/3/6" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/3/6" id="section-3-6"><Pnumber>6</Pnumber><P2para><Text>A contract entered into by a district council falls within this subsection if it is entered into, in connection with a contract falling within subsection (5), with—</Text><P3 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/3/6/a" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/3/6/a" id="section-3-6-a"><Pnumber>a</Pnumber><P3para><Text>a person who, in connection with that contract, makes a loan to, or provides any other form of finance for, a party to that contract other than the district council; RestrictStartDate="2015-04-01"><Title>Absence of relevant discharge terms</Title><P1 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/7" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/7" id="section-7"><Pnumber PuncAfter=""><CommentaryRef Ref="key-56f81d67e31090cd5f6c7f2428a0fb2d"/>7</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/7/1" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/7/1" id="section-7-1"><Pnumber>1</Pnumber><P2para><Text>Subsection (2) applies where—</Text><P3 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/7/1/a" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/7/1/a" id="section-7-1-a"><Pnumber>a</Pnumber><P3para><Text>the result of a determination or order made by a court on an application for judicial review <CommentaryRef Ref="key-569d6325a775b1f8a087b51edd8ff7d5"/>... is that a certified contract does not have effect; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/7/1/b" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/7/1/b" id="section-7-1-b"><Pnumber>b</Pnumber><P3para><Text>there are no relevant discharge terms having effect between the district council and a person who is a party to the contract.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/7/2" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/7/2" id="section-7-2"><Pnumber>2</Pnumber><P2para><Text>That person shall be entitled to be paid by the district council such sums (if any) as that person would have been entitled to be paid by the district council if the contract—</Text><P3 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/7/2/a" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/7/2/a" id="section-7-2-a"><Pnumber>a</Pnumber><P3para><Text>had had effect until the time when the determination or order was made; but</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/7/2/b" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/7/2/b" id="section-7-2-b"><Pnumber>b</Pnumber><P3para><Text>had been terminated at that time by acceptance by that person of a repudiatory breach by the district council.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/7/3" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/7/3" id="section-7-3"><Pnumber>3</Pnumber><P2para><Text>For the purposes of this section the circumstances in which there are no relevant discharge terms having effect between the district council and a person who is a party to the contract include (as well as circumstances in which no such terms have been agreed) circumstances in which the result of a determination or order of a court, made (despite section 6(4)) on an application for judicial review <CommentaryRef Ref="key-2e81f24502595f6afbe83d6cde9c1d0a"/>..., is that such terms do not have effect.</Text></P2para></P2></P1para></P1></P1group><P1group RestrictExtent="N.I." id="section-10-1-b-ii"><Pnumber>ii</Pnumber><P4para><Text>which includes a term allowing the consideration payable by the council to be varied;</Text></P4para></P4></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/10/1/c" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/10/1/c" id="section-10-1-c"><Pnumber>c</Pnumber><P3para><Text>enter into any non-capital contract under which the consideration payable by the council exceeds a specified sum, where—</Text><P4 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/10/1/c/i" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/10/1/c/i" id="section-10-1-c-i"><Pnumber>i</Pnumber><P4para><Text>the period of the contract extends beyond a specified date; id="section-10-2"><Pnumber>2</Pnumber><P2para><Text>In subsection (1)—</Text><UnorderedList Decoration="none" Class="Definition"><ListItem><Para><Text>“<Term id="term-capital-contract">capital contract</Term>” means a contract as regards which the consideration payable by the council is capital expenditure;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-capital-expenditure">capital expenditure</Term>” means expenditure which falls to be capitalised in accordance with proper practices (within the meaning of Article 6(3) of the Local Government (Northern Ireland) Order 2005 (NI 18));</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-non-capital-contract">non-capital contract</Term>” means a contract which is not a capital contract.</Text></Para></ListItem></UnorderedList></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/10/3" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/10/3" id="section-10-3"><Pnumber>3</Pnumber><P2para><Text>A direction under subsection (1)(b) or (c) may provide that the consent of <Addition ChangeId="key-a91238fa6b23e1c6eb3e31d3f89e56c4-1454674087244" CommentaryRef="key-a91238fa6b23e1c6eb3e31d3f89e56c4">a successor council or</Addition>a specified statutory transition committee is not required in relation to a contract of a specified description.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/10/4" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/10/4" id="section-10-4"><Pnumber>4</Pnumber><P2para><Text>A direction—</Text><P3 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/10/4/a" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/10/4/a" id="section-10-4-a"><Pnumber>a</Pnumber><P3para><Text>shall be in writing;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/10/4/b" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/10/4/b" id="section-10-4-b"><Pnumber>b</Pnumber><P3para><Text>may make different provision in relation to different matters for which consent is required;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/10/4/c" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/10/4/c" id="section-10-4-c"><Pnumber>c</Pnumber><P3para><Text>may be varied or revoked by a subsequent direction.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/10/5" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/10/5" id="section-10-5"><Pnumber>5</Pnumber><P2para><Text>In this Chapter—</Text><UnorderedList Decoration="none" Class="Definition"><ListItem><Para><Text>“<Term id="term-direction">direction</Term>” means a direction under this section;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-specified">specified</Term>”, in relation to a direction, means specified in the direction;</Text></Para></ListItem><ListItem><Para><Text>“<Term consideration with respect to any other disposal of land made by the council after a specified date is to be taken into account.</Text></P2para></P2><P2 same or a similar description of matter as that to which the contract in question relates.</Text></P3para></P3></P2para></P2></P1para></P1></P1group><P1group RestrictExtent="N.I." RestrictStartDate="2014-06-02"><Title>Referral to Department where consent refused or granted subject to conditions</Title><P1 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/13" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/13" id="section-13"><Pnumber PuncAfter="">13</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/13/1" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/13/1" id="section-13-1"><Pnumber>1</Pnumber><P2para><Text>This section applies where—</Text><P3 IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/13/1/b" id="section-13-1-b"><Pnumber>b</Pnumber><P3para><Text>that consent is refused by<Addition ChangeId="key-24bfa7db9228af965b9964212f6c166b-1454686873779" CommentaryRef="key-24bfa7db9228af965b9964212f6c166b">the successor council or</Addition> the statutory transition committee or is given subject to conditions.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/13/2" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/13/2" id="section-14-1"><Pnumber>1</Pnumber><P2para><Text>A disposal made in contravention of a direction is void.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/14/2" purposes of Part 1 is not a certified contract for those purposes if it is entered into in contravention of a direction.</Text></P2para></P2></P1para></P1></P1group></Chapter><Chapter DocumentURI="http://www.legislation.gov.uk/nia/2010/7/part/2/chapter/3" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/part/2/chapter/3" NumberOfProvisions="4" id="part-2-chapter-3" RestrictStartDate="2014-06-02"><Number>CHAPTER 3</Number><Title>STATUTORY TRANSITION COMMITTEES</Title><P1group RestrictStartDate="2010-03-27" ConfersPower="true"><Title>Statutory transition committees: constitution</Title><P1 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/15" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/15" id="section-15"><Pnumber PuncAfter="">15</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/15/1" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/15/1" id="section-15-1"><Pnumber>1</Pnumber><P2para><Text>In relation to each new council there shall be a body called a statutory transition committee.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/15/2" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/15/2" id="section-15-2"><Pnumber>2</Pnumber><P2para><Text>A statutory transition committee shall be a body corporate to which, subject to the provisions of this Chapter, section 19 of the Interpretation Act (Northern Ireland) 1954 (c. 33) shall apply.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/15/3" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/15/3" id="section-15-3"><Pnumber>3</Pnumber><P2para><Text>The Department shall by regulations provide for the establishment of statutory transition committees.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/15/4" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/15/4" id="section-15-4"><Pnumber>4</Pnumber><P2para><Text>Those regulations shall ensure that—</Text><P3 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/15/4/a" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/15/4/a" id="section-15-4-a"><Pnumber>a</Pnumber><P3para><Text>the statutory transition committee in relation to the new council for the district of Belfast consists of members of the predecessor council and members of Castlereagh Borough Council and Lisburn City Council;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/15/4/b" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/15/4/b" id="section-15-4-b"><Pnumber>b</Pnumber><P3para><Text>the statutory transition committee in relation to any other new council consists of members of the predecessor councils.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/15/5" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/15/5" id="section-15-5"><Pnumber>5</Pnumber><P2para><Text>Those regulations may make provision as to—</Text><P3 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/15/5/a" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/15/5/a" id="section-15-5-a"><Pnumber>a</Pnumber><P3para><Text>the appointment of the Chair and other members of a statutory transition committee (including the number of members to be appointed from each council mentioned in subsection (4) and any conditions to be fulfilled for appointment);</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/15/5/b" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/15/5/b" id="section-15-5-b"><Pnumber>b</Pnumber><P3para><Text>the tenure of office of the Chair and other members (including the circumstances in which they cease to hold office or may be removed or suspended from office).</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/15/6" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/15/6" id="section-15-6"><Pnumber>6</Pnumber><P2para><Text>Regulations may make provision for, or in connection with—</Text><P3 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/15/6/a" committees;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/15/6/b" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/15/6/b" id="section-15-6-b"><Pnumber>b</Pnumber><P3para><Text>the payment of allowances to members of statutory transition committees;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/15/6/c" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/15/6/c" id="section-15-6-c"><Pnumber>c</Pnumber><P3para><Text>the making available to statutory transition committees of the facilities, staff and premises of existing councils;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/15/6/d" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/15/6/d" id="section-15-6-d"><Pnumber>d</Pnumber><P3para><Text>such other matters in connection with the efficient and effective discharge by statutory transition committees of their functions as the Department thinks appropriate.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/15/7" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/15/7" id="section-15-7"><Pnumber>7</Pnumber><P2para><Text>The Department may make payments to statutory transition committees on such terms and conditions as the Department may determine.</Text></P2para></P2><P2 councils.</Text></P3para></P3></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2010-03-27" ConfersPower="true"><Title>Statutory transition committees: functions</Title><P1 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/16" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/16" id="section-16"><Pnumber PuncAfter="">16</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/16/1" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/16/1" id="section-16-1"><Pnumber>1</Pnumber><P2para><Text>The functions of a statutory transition committee are exercisable for the purpose of preparing for, and giving full effect to, the reorganisation of local government provided for by the Local Government (Boundaries) Act (Northern Ireland) 2008 (c. 7) and, in particular for facilitating—</Text><P3 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/16/1/a" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/16/1/a" id="section-16-1-a"><Pnumber>a</Pnumber><P3para><Text>the exercise of their functions by new councils as from their initial constitution; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/16/1/b" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/16/1/b" id="section-16-1-b"><Pnumber>b</Pnumber><P3para><Text>the winding-up of existing councils and the transfer of their assets, liabilities and staff.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/16/2" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/16/2" id="section-16-2"><Pnumber>2</Pnumber><P2para><Text>Subject to any provision made by regulations, a statutory transition committee may do anything which appears to it to be necessary or expedient for the purpose mentioned in subsection (1).</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/16/3" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/16/3" id="section-16-3"><Pnumber>3</Pnumber><P2para><Text>The Department may by regulations make provision for, or in connection with, conferring powers or imposing duties on statutory transition committees.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/16/4" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/16/4" id="section-16-4"><Pnumber>4</Pnumber><P2para><Text>In particular, regulations may make provision for, or in connection with, conferring powers or imposing duties on a statutory transition committee to—</Text><P3 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/16/4/a" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/16/4/a" id="section-16-4-a"><Pnumber>a</Pnumber><P3para><Text>make a district rate (within the meaning of Article 6(3) of the Rates (Northern Ireland) Order 1977 (NI 28));</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/nia/2010/7/section/16/4/b" IdURI="http://www.legislation.gov.uk/id/nia/2010/7/section/16/4/b" id="section-16-4-b"><Pnumber>b</Pnumber><P3para><Text>appoint staff for the purposes of a new council.</Text></P3para></P3></P2para></P2></P1para></P1></P1group><P1group RestrictExtent="N.I." Order 1997 (NI 19); or</Text></Para></ListItem><ListItem NumberOverride="b"><Para><Text>for the purposes of, or in connection with, the exercise of such functions;</Text></Para></ListItem></OrderedList></ListItem><ListItem><Para><Text>“<Term id="term-waste-management-contract">waste management contract</Term>” means a contract for the purposes of, or
