http://www.legislation.gov.uk/nia/2008/7Local Government (Boundaries) Act (Northern Ireland) 2008An Act to provide for 11 local government districts in Northern Ireland, for the division of those districts into wards, for the appointment of a Local Government Boundaries Commissioner to recommend the boundaries and names of those districts and wards and the number of wards in each district; and for connected purposes.texttext/xmlenStatute Law Database2017-08-03Expert Participation2016-05-08Local Government (Boundaries) Act (Northern Ireland) 20082008 CHAPTER 7An Act to provide for 11 local government districts in Northern Ireland, for the division of those districts into wards, for the appointment of a Local Government Boundaries Commissioner to recommend the boundaries and names of those districts and wards and the number of wards in each district; and for connected purposes.[23rd May 2008]BE IT ENACTED by being passed by the Northern Ireland Assembly and assented to by Her Majesty as follows:Local government districts and wards11For the purposes of local government, Northern Ireland shall be divided into 11 districts (to be known as “local government districts”).2The 11 local government districts shall incorporate, respectively, the whole or the major part of the following former local government districts—1Antrim; Newtownabbey.2Ards; North Down.3Armagh City and District; Banbridge; Craigavon.4Ballymena; Carrickfergus; Larne.5Ballymoney; Coleraine; Limavady; Moyle.6Belfast.7Castlereagh; Lisburn City.8Cookstown; Dungannon and South Tyrone Borough; Magherafelt.9Derry; Strabane.10Down; Newry and Mourne.11Fermanagh; Omagh.3Each local government district shall be divided into wards.4The boundaries and names of the local government districts and the number, boundaries and names of the wards into which each of those districts is divided shall be such as are prescribed by an order made under section 50(10) of the principal Act.5Reference in subsection (2) to a former local government district is to that district as constituted on the date on which this Act receives Royal Assent.Local Government Boundaries Commissioner21The principal Act is amended as follows.2In section 50 (local government boundaries) for subsections (1) and (2) substitute—1The Department shall appoint a Local Government Boundaries Commissioner—ain the year 2008; andbthereafter, during the period not less than 8 or more than 12 years from the date of the submission under subsection (6) of the final report of the last previous Commissioner appointed under this subsection.2The function of a Commissioner appointed under subsection (1)(a) shall be to make recommendations regarding—athe boundaries and names of the 11 districts mentioned in section 1 of the Local Government (Boundaries) Act (Northern Ireland) 2008; andbthe number, boundaries and names of the wards into which each district is to be divided..3In Schedule 4 (provisions relating to the Commissioner)—afor paragraph 3(2)(c) substitute—cthe Chief Survey Officer of Land and Property Services; and;bfor paragraph 6(2)(b) substitute—bthat he will in due course publish provisional recommendations and cause a public hearing to be held in each of the 11 districts mentioned in section 1 of the Local Government (Boundaries) Act (Northern Ireland) 2008.;cfor paragraph 18 substitute—181Subject to sub-paragraphs (2) and (3)—ain the district of Belfast the number of wards shall be 60;bin each other district the number of wards shall be 40.2Where, having regard to the matters mentioned in paragraph 17, the Commissioner considers it desirable that the number of wards in any district should be more than that specified in sub-paragraph (1), the number of wards in that district may be increased by not more than 5.3Where, having regard to the matters mentioned in paragraph 17, the Commissioner considers it desirable that the number of wards in any district should be fewer than that specified in sub-paragraph (1), the number of wards in that district may be decreased by not more than 5..Consequential amendment and repeals31In section 1(1) of the principal Act for “the Local Government (Boundaries) Act (Northern Ireland) 1971” substitute “

”.2The statutory provisions set out in the Schedule are repealed to the extent mentioned in column 2 of the Schedule.Interpretation41In this Act—“the Department” means the Department of the Environment;“the principal Act” means the Local Government Act (Northern Ireland) 1972 (c. 9).2Expressions used in this Act and in the principal Act have the same meaning in this Act as in that Act.Commencement51Subject to subsections (2) and (3), this Act comes into operation on Royal Assent.2Section 1 comes into operation—afor the purposes of—ithe exercise by the Department and the Local Government Boundaries Commissioner of their functions under section 50 of, and Schedule 4 to, the principal Act, andiithe exercise by the Secretary of State and the District Electoral Areas Commissioner of their functions under Article 2 of the District Electoral Areas Commissioner (Northern Ireland) Order 1984 (No. 360),one week after the date of Royal Assent;bfor other purposes on such date or dates as the Department may by order appoint.3Section 3(1) and the repeal, by section 3(2) and the Schedule, of the Local Government (Boundaries) Act (Northern Ireland) 1971 (c. 9) come into operation on such date or dates as the Department may by order appoint.4An order under this section may contain such transitional or transitory provisions and such savings as appear to the Department to be necessary or expedient.Short title6This Act may be cited as the Local Government (Boundaries) Act (Northern Ireland) 2008.SCHEDULEREPEALSSection 3
