id="section-29"><Pnumber PuncAfter="">29</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/nia/2008/12/section/29/1" IdURI="http://www.legislation.gov.uk/id/nia/2008/12/section/29/1" id="section-29-1"><Pnumber>1</Pnumber><P2para><Text>The power of the Court or the Commission to make schemes for the application of property cy-près shall be exercised in accordance with this section.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/nia/2008/12/section/29/2" IdURI="http://www.legislation.gov.uk/id/nia/2008/12/section/29/2" id="section-29-2"><Pnumber>2</Pnumber><P2para><Text>Where any property given for charitable purposes is applicable cy-près, the Court or the Commission may make a scheme providing for the property to be applied—</Text><P3 DocumentURI="http://www.legislation.gov.uk/nia/2008/12/section/29/2/a" IdURI="http://www.legislation.gov.uk/id/nia/2008/12/section/29/2/a" id="section-29-2-a"><Pnumber>a</Pnumber><P3para><Text>for such charitable purposes, and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/nia/2008/12/section/29/2/b" IdURI="http://www.legislation.gov.uk/id/nia/2008/12/section/29/2/b" id="section-29-2-b"><Pnumber>b</Pnumber><P3para><Text>(if the scheme provides for the property to be transferred to another charity) by or on trust for such other charity,</Text></P3para></P3><Text>as it considers appropriate, having regard to the matters set out in subsection (3).</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/nia/2008/12/section/29/3" IdURI="http://www.legislation.gov.uk/id/nia/2008/12/section/29/3" id="section-29-3"><Pnumber>3</Pnumber><P2para><Text>The matters are—</Text><P3 DocumentURI="http://www.legislation.gov.uk/nia/2008/12/section/29/3/a" IdURI="http://www.legislation.gov.uk/id/nia/2008/12/section/29/3/a" id="section-29-3-a"><Pnumber>a</Pnumber><P3para><Text>the spirit of the original gift,</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/nia/2008/12/section/29/3/b" IdURI="http://www.legislation.gov.uk/id/nia/2008/12/section/29/3/b" id="section-29-3-b"><Pnumber>b</Pnumber><P3para><Text>the desirability of securing that the property is applied for charitable purposes which are close to the original purposes, and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/nia/2008/12/section/29/3/c" IdURI="http://www.legislation.gov.uk/id/nia/2008/12/section/29/3/c" id="section-29-3-c"><Pnumber>c</Pnumber><P3para><Text>the need for the relevant charity to have purposes which are suitable and effective in the light of current social and economic circumstances.</Text></P3para></P3></P2para><P2para><Text>The  “<Term id="term-relevant-charity">relevant charity</Term>” means the charity by or on behalf of which the property is to be applied under the scheme.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/nia/2008/12/section/29/4" IdURI="http://www.legislation.gov.uk/id/nia/2008/12/section/29/4" id="section-29-4"><Pnumber>4</Pnumber><P2para><Text>If a scheme provides for the property to be transferred to another charity, the scheme may impose on the charity trustees of that charity a duty to secure that the property is applied for purposes which are, so far as is reasonably practicable, similar in character to the original purposes.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/nia/2008/12/section/29/5" IdURI="http://www.legislation.gov.uk/id/nia/2008/12/section/29/5" id="section-29-5"><Pnumber>5</Pnumber><P2para><Text>In this section references to property given include the property for the time being representing the property originally given or property derived from it.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/nia/2008/12/section/29/6" IdURI="http://www.legislation.gov.uk/id/nia/2008/12/section/29/6" id="section-29-6"><Pnumber>6</Pnumber><P2para><Text>In this section references to the transfer of property to a charity are references to its transfer—</Text><P3 DocumentURI="http://www.legislation.gov.uk/nia/2008/12/section/29/6/a" IdURI="http://www.legislation.gov.uk/id/nia/2008/12/section/29/6/a" id="section-29-6-a"><Pnumber>a</Pnumber><P3para><Text>to the charity, or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/nia/2008/12/section/29/6/b" IdURI="http://www.legislation.gov.uk/id/nia/2008/12/section/29/6/b" id="section-29-6-b"><Pnumber>b</Pnumber><P3para><Text>to the charity trustees, or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/nia/2008/12/section/29/6/c" IdURI="http://www.legislation.gov.uk/id/nia/2008/12/section/29/6/c" id="section-29-6-c"><Pnumber>c</Pnumber><P3para><Text>to any trustee for the charity, or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/nia/2008/12/section/29/6/d" IdURI="http://www.legislation.gov.uk/id/nia/2008/12/section/29/6/d" id="section-29-6-d"><Pnumber>d</Pnumber><P3para><Text>to a person nominated by the charity trustees to hold it in trust for the charity,</Text></P3para></P3><Text>as the scheme may provide.</Text></P2para></P2><P2 the application of the property given has been altered or regulated by a scheme or otherwise, as referring to the purposes for which the property is for the time being
