PuncAfter="">124</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/nia/2008/12/section/124/1" IdURI="http://www.legislation.gov.uk/id/nia/2008/12/section/124/1" id="section-124-1"><Pnumber>1</Pnumber><P2para><Text>This section deals with circumstances in which a resolution under section 123(2) either—</Text><P3 DocumentURI="http://www.legislation.gov.uk/nia/2008/12/section/124/1/a" IdURI="http://www.legislation.gov.uk/id/nia/2008/12/section/124/1/a" id="section-124-1-a"><Pnumber>a</Pnumber><P3para><Text>does not take effect under section 123(8), or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/nia/2008/12/section/124/1/b" IdURI="http://www.legislation.gov.uk/id/nia/2008/12/section/124/1/b" id="section-124-1-b"><Pnumber>b</Pnumber><P3para><Text>takes effect at a time later than that mentioned in section 123(8).</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/nia/2008/12/section/124/2" IdURI="http://www.legislation.gov.uk/id/nia/2008/12/section/124/2" id="section-124-2"><Pnumber>2</Pnumber><P2para><Text>A resolution does not take effect under section 123(8) if before the end of—</Text><P3 DocumentURI="http://www.legislation.gov.uk/nia/2008/12/section/124/2/a" IdURI="http://www.legislation.gov.uk/id/nia/2008/12/section/124/2/a" id="section-124-2-a"><Pnumber>a</Pnumber><P3para><Text>the period of 60 days mentioned in section 123(8) (“the 60-day period”), or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/nia/2008/12/section/124/2/b" IdURI="http://www.legislation.gov.uk/id/nia/2008/12/section/124/2/b" id="section-124-2-b"><Pnumber>b</Pnumber><P3para><Text>that period as modified by subsection (3) or (4),</Text></P3para></P3><Text>the Commission notifies the charity trustees in writing that it objects to the resolution, either on procedural grounds or on the merits of the proposals contained in the resolution.</Text></P2para></P2><UnorderedList Decoration="none" Class="Definition"><ListItem><Para><Text>“<Term id="term-on-procedural-grounds">On procedural grounds</Term>” means on the grounds that any obligation imposed on the charity trustees by or under section 123 has not been complied with in connection with the resolution.</Text></Para></ListItem></UnorderedList><P2 DocumentURI="http://www.legislation.gov.uk/nia/2008/12/section/124/3" IdURI="http://www.legislation.gov.uk/id/nia/2008/12/section/124/3" id="section-124-3"><Pnumber>3</Pnumber><P2para><Text>If under section 123(6) the Commission directs the charity trustees to give public notice of a resolution, the running of the 60-day period is suspended by virtue of this subsection—</Text><P3 DocumentURI="http://www.legislation.gov.uk/nia/2008/12/section/124/3/a" IdURI="http://www.legislation.gov.uk/id/nia/2008/12/section/124/3/a" id="section-124-3-a"><Pnumber>a</Pnumber><P3para><Text>as from the date on which the direction is given to the charity trustees, and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/nia/2008/12/section/124/3/b" IdURI="http://www.legislation.gov.uk/id/nia/2008/12/section/124/3/b" id="section-124-3-b"><Pnumber>b</Pnumber><P3para><Text>until the end of the period of 42 days beginning with the date on which public notice of the resolution is given by the charity trustees.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/nia/2008/12/section/124/4" IdURI="http://www.legislation.gov.uk/id/nia/2008/12/section/124/4" id="section-124-4"><Pnumber>4</Pnumber><P2para><Text>If under section 123(7) the Commission directs the charity trustees to provide any information or explanations, the running of the 60-day period is suspended by virtue of this subsection—</Text><P3 DocumentURI="http://www.legislation.gov.uk/nia/2008/12/section/124/4/a" IdURI="http://www.legislation.gov.uk/id/nia/2008/12/section/124/4/a" id="section-124-4-a"><Pnumber>a</Pnumber><P3para><Text>as from the date on which the direction is given to the charity trustees, and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/nia/2008/12/section/124/4/b" IdURI="http://www.legislation.gov.uk/id/nia/2008/12/section/124/4/b" id="section-124-4-b"><Pnumber>b</Pnumber><P3para><Text>until the date on which the information or explanations is or are provided to the Commission.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/nia/2008/12/section/124/5" IdURI="http://www.legislation.gov.uk/id/nia/2008/12/section/124/5" id="section-124-5"><Pnumber>5</Pnumber><P2para><Text>Subsection (6) applies once the period of time, or the total period of time, during which the 60-day period is suspended by virtue of either or both of subsections (3) and (4) exceeds 120 days.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/nia/2008/12/section/124/6" IdURI="http://www.legislation.gov.uk/id/nia/2008/12/section/124/6" id="section-124-6"><Pnumber>6</Pnumber><P2para><Text>At that point the resolution (if not previously objected to by the Commission) is to be treated as if it had never been
