3Llunio a chyhoeddi'r cynllun

(1)Wrth lunio, ail-wneud neu adolygu cynllun y plant, rhaid i Weinidogion Cymru roi sylw i—
(a)unrhyw adroddiad gan y Pwyllgor o dan erthygl 44(5) neu astudiaeth a wneir o dan erthygl 45(c);
(b)unrhyw adroddiadau, awgrymiadau, argymhellion cyffredinol neu ddogfennau eraill a ddyroddir gan y Pwyllgor sy'n ymwneud â rhoi'r Confensiwn neu'r Protocolau ar waith gan y Deyrnas Unedig.
(2)Wrth lunio, ail-wneud neu adolygu cynllun y plant, caiff Gweinidogion Cymru roi sylw i unrhyw ddogfennau eraill (p'un a ddyroddir hwy gan y Pwyllgor ai peidio) ac i unrhyw faterion eraill sydd yn eu barn hwy yn berthnasol.
(3)Cyn gwneud, ail-wneud neu adolygu cynllun y plant, rhaid i Weinidogion Cymru gyhoeddi drafft o'r—
(a)cynllun, neu
(b)pan fônt yn bwriadu adolygu'r cynllun, naill ai'r adolygiadau neu'r cynllun fel y'i adolygwyd.
(4)Wrth lunio drafft i'w gyhoeddi o dan is-adran (3), rhaid i Weinidogion Cymru sicrhau bod—
(a)plant a phobl ifanc,
(b)Comisiynydd Plant Cymru, ac
(c)unrhyw bobl neu gyrff eraill y mae Gweinidogion Cymru yn barnu eu bod yn briodol,
yn cael rhan mewn llunio'r drafft.
(5)Cyn gwneud, ail-wneud neu adolygu cynllun y plant, rhaid i Weinidogion Cymru ymgynghori â'r bobl a ganlyn ynghylch y drafft a gyhoeddir o dan is-adran (3)—
(a)plant a phobl ifanc,
(b)Comisiynydd Plant Cymru, ac
(c)unrhyw bobl neu gyrff eraill y mae Gweinidogion Cymru yn barnu eu bod yn briodol.
(6)Rhaid i Weinidogion Cymru beidio â gwneud, ail-wneud nac adolygu cynllun y plant oni bai bod drafft o'r—
(a)cynllun, neu
(b)pan fônt yn bwriadu adolygu'r cynllun, naill ai'r adolygiadau neu'r cynllun fel y'i adolygwyd,
wedi ei osod gerbron y Cynulliad ac wedi ei gymeradwyo drwy benderfyniad gan y Cynulliad.
(7)Rhaid i Weinidogion Cymru osod drafft o'r cynllun gerbron y Cynulliad (yn unol ag is-adran (6)(a)) ar neu cyn 31 Mawrth 2012.
(8)Rhaid i Weinidogion Cymru gyhoeddi cynllun y plant pan fyddant yn ei wneud a phryd bynnag y byddont yn ei ail-wneud; ac, os ydynt yn adolygu'r cynllun heb ei ail-wneud, rhaid iddynt gyhoeddi naill ai'r adolygiadau neu'r cynllun fel y'i adolygwyd (fel sy'n briodol yn eu barn hwy).
(9)Os yw Gweinidogion Cymru yn cyhoeddi cynllun neu adolygiadau o dan is-adran (8) rhaid iddynt osod copi o'r cynllun neu'r adolygiadau gerbron y Cynulliad.
(10)Yn yr adran hon—
(a)ystyr “y Pwyllgor” yw'r Pwyllgor ar Hawliau'r Plentyn a sefydlwyd o dan erthygl 43(1); a
(b)mae unrhyw gyfeiriad at erthygl yn gyfeiriad at yr erthygl honno o'r Confensiwn.
