Functions relating to scientific research to be exercisable concurrently

2.—(1) The functions of the Secretary of State under section 5(1) of the Science and Technology Act 1965(1) shall be exercisable concurrently by the Minister of Agriculture, Fisheries and Food.

(2) In section 5(1) of that Act—

(a)after the words “Secretary of State”, where they appear for the first time, there shall be inserted the words “or the Minister of Agriculture, Fisheries and Food”, and

(b)after the words “Secretary of State”, where they appear for the second time, there shall be inserted the words “or, as the case may be, the Minister of Agriculture, Fisheries and Food”.

(3) Nothing in this article shall be taken as implying that the functions of the Secretary of State under section 99 of the Electricity Act 1989(2) are to become exercisable concurrently by the Minister of Agriculture, Fisheries and Food.

Relevant amendments to section 5(1) were made by the Transfer of Functions (Science) Order 1992 (S.I. 1992/1296), article 6 and paragraph 2 of the Schedule, the Transfer of Functions (Science) Order 1995 (S.I. 1995/2985), article 5 and paragraph 1 of the Schedule, the Scotland Act 1998 (c. 46), sections 53, 55, 56(1)(d), 117 and 119(2), the Government of Wales Act 1998 (c. 38), sections 43(1) and 89 and the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672), article 2 and Schedule 1.
