amending Regulation (EC) No 1907/2006 of the European Parliament and of the Council as regards the percentage of registration dossiers to be selected for compliance checking

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EC) No 1907/2006 of the European Parliament and of the Council of 18 December 2006 concerning the Registration, Evaluation, Authorisation and Restriction of Chemicals (REACH), establishing a European Chemicals Agency, amending Directive 1999/45/EC and repealing Council Regulation (EEC) No 793/93 and Commission Regulation (EC) No 1488/94 as well as Council Directive 76/769/EEC and Commission Directives 91/155/EEC, 93/67/EEC, 93/105/EC and 2000/21/EC1, and in particular Article 41(7) thereof,

Whereas:

In order to ensure that registration dossiers comply with Regulation (EC) No 1907/2006, Article 41 of that Regulation requires the European Chemicals Agency (‘the Agency’) to select a specific percentage of registration dossiers for compliance checking. This check may lead to a draft decision requiring the registrant(s) to submit any information needed to bring the registration(s) into compliance with the relevant information requirements.

The assessment by the Agency2 and the Commission3 concerning the operation of Regulation (EC) No 1907/2006 as well as a study conducted by the German competent authorities4 indicate that likely a significant number of the registration dossiers are non-compliant, hampering the effective achievement of the objectives of Regulation (EC) No 1907/2006.

In the ‘General Report on the operation of REACH and review of certain elements’, the Commission identified non-compliance of registration dossiers as an issue requiring urgent action.

Following the expiry of the last registration deadline, better advance planning with regard to compliance checks is possible based on improved knowledge of the actual numbers of registered substances and the dossier evaluation experience acquired by the Agency.

Following consultation with the Agency as reflected in the REACH evaluation Joint Action Plan5 agreed by the Commission services and ECHA, which the Council has requested in its Conclusions of 26 June 20196, the Commission considers that in order to enhance compliance with the relevant information requirements, the minimum percentage of registration dossiers to be checked for compliance on all elements listed in Article 41(1) of Regulation (EC) No 1907/2006 should be increased from 5 % to 20 % of the total received by the Agency for each tonnage band by the 2018 deadline. Such percentage is considered realistic for the Agency in view of its resources.

In the Joint Action Plan agreed by the Commission services and ECHA, it has been agreed that the target of 20 % should be achieved by 31 December 2023 for registrations in tonnage bands of 100 tonnes or more per year and by 31 December 2027 for registrations in tonnage bands of less than 100 tonnes per year, submitted by the 2018 deadline.

Regulation (EC) No 1907/2006 should therefore be amended accordingly.

The measures provided for in this Regulation are in accordance with the opinion of the Committee established under Article 133 of Regulation (EC) No 1907/2006,
