THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard Regulation (EU) No 168/2013 of the European Parliament and of the Council of 15 January 2013 on the approval and market surveillance of two- or three-wheel vehicles and quadricycles(1), and in particular Article 27(4), Article 29(4), Article 32(1) and Article 38(2) thereof,
Whereas:
(1) Pursuant to the requirements introduced by Regulation (EU) 2019/129 of the European Parliament and of the Council(2) as regards the application of the environmental step Euro 5 for L-category vehicles, certain sub-categories of vehicles will have to comply with additional technical requirements as from certain dates. Other sub-categories are exempted or are required to comply with certain requirements later than originally set out in Regulation (EU) No 168/2013.
(2) The administrative type-approval templates laid down in Commission Implementing Regulation (EU) No 901/2014(3) should be adapted in light of the amendments provided for in Regulation (EU) 2019/129 to facilitate the type-approval process and to enable national authorities to verify compliance with the requirements of environmental steps Euro 5 and Euro 5+ applicable at a given date.
(3) Implementing Regulation (EU) No 901/2014 should therefore be amended accordingly.
(4) The measures provided for in this Regulation are in accordance with the opinion of the Technical Committee – Motor Vehicles,
HAS ADOPTED THIS REGULATION:
Regulation (EU) 2019/129 of the European Parliament and of the Council of 16 January 2019 amending Regulation (EU) No 168/2013 as regards the application of the Euro 5 step to the type-approval of two- or three-wheel vehicles and quadricycles (OJ L 30, 31.1.2019, p. 106).
