amending Implementing Regulation (EU) 2016/799 for the purpose of on-board weighing equipment

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EU) No 165/2014 of the European Parliament and of the Council of 4 February 2014 on tachographs in road transport1, and in particular Article 11 thereof,

Whereas:

Installation of on-board weighing equipment is an option provided for the Member States by Article 10d(5) of Council Directive 96/53/EC2 for carrying out the control of vehicles or vehicle combinations that are likely to have exceeded the maximum authorised weight.

Commission Implementing Regulation (EU) 2019/12133 lays down detailed provisions ensuring uniform interoperability and compatibility rules of on-board weighing equipment.

Since the requirements of Commission Implementing Regulation (EU) 2019/1213 are in conflict with the provisions on on-board weighing equipment set out in Appendix 14 to Annex IC to Implementing Regulation (EU) 2016/7994, that Annex should therefore be amended in order to delete point 5.5 of Appendix 14.

The measures provided for in this Commission Implementing Regulation are in accordance with the opinion of the Road Transport Committee, referred to in Article 42(3) of Regulation (EU) No 165/2014,

HAS ADOPTED THIS REGULATION:

Article 1

Point 5.5 of Appendix 14 to Annex IC to Implementing Regulation (EU) 2016/799 is deleted.

Article 2Entry into force and application

This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.
