For the purposes of this Regulation, the following definitions shall apply:

1. (1)
   the definitions of ‘food’, ‘food business operator’, ‘retail’‘placing on the market’ and ‘final consumer’ laid down in Articles 2 and 3 of Regulation (EC) No 178/2002 of the European Parliament and of the Council7;
2. (2)

   ‘benchmark levels’ means performance indicators used to verify the effectiveness of the mitigation measures and are based on experience and occurrence for broad food categories.

3. (3)

   F1“competent authority” means the central authority competent to ensure compliance with the requirements of this Regulation or any other authority to which that central authority has delegated competence;

4. (4)

   “appropriate authority” means—

   1. (a)

      in relation to England, the Secretary of State;

   2. (b)

      in relation to Wales, the Welsh Ministers;

   3. (c)

      in relation to Scotland, the Scottish Ministers.
