It is necessary to provide a standard format for submitting such applications and to list the information requested to accompany such applications.</p></blockContainer><blockContainer class="division" uk:name="division"><num>(3)</num><p>Under certain circumstances, the Commission, a Member State, an interested party or organisation may submit a request to EMA for an opinion to establish the MRL. It is necessary to provide a standard format for such requests and to list the information that should accompany them.</p></blockContainer><blockContainer class="division" uk:name="division"><num>(4)</num><p>The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Veterinary Medicinal Products,</p></blockContainer><p>HAS ADOPTED THIS REGULATION:</p></preamble><body eId="body"><article eId="article-1"><num>Article 1</num><heading>Form and content of applications and requests</heading><paragraph eId="article-1-1"><num>1.</num><content><p>An application or a request for the establishment of maximum residue limits (MRLs) shall be submitted to  <ins class="substitution first last" ukl:ChangeId="key-3d5378bf3b75c7b418696a662249f56d-1721224852066" ukl:CommentaryRef="key-3d5378bf3b75c7b418696a662249f56d"><noteRef uk:name="commentary" href="#key-3d5378bf3b75c7b418696a662249f56d" class="commentary"/>the appropriate authority</ins>  electronically.</p></content></paragraph><paragraph eId="article-1-2"><num>2.</num><content><p>The particulars and documents accompanying an application or a request for the establishment of MRLs shall be presented in accordance with the requirements set out in the Annex.</p></content></paragraph><paragraph eId="article-1-2"><num><ins class="first" ukl:ChangeId="key-167fb267ecc1908cfd36a22a68b6f8da-1721224829874" ukl:CommentaryRef="key-167fb267ecc1908cfd36a22a68b6f8da"><noteRef uk:name="commentary" href="#key-167fb267ecc1908cfd36a22a68b6f8da" class="commentary"/>3.</ins></num><content><p><ins ukl:ChangeId="key-167fb267ecc1908cfd36a22a68b6f8da-1721224829874" ukl:CommentaryRef="key-167fb267ecc1908cfd36a22a68b6f8da">In this Regulation,  “</ins><term refersTo="#term-appropriate-authority"><ins ukl:ChangeId="key-167fb267ecc1908cfd36a22a68b6f8da-1721224829874" ukl:CommentaryRef="key-167fb267ecc1908cfd36a22a68b6f8da">appropriate authority</ins></term><ins class="last" ukl:ChangeId="key-167fb267ecc1908cfd36a22a68b6f8da-1721224829874" ukl:CommentaryRef="key-167fb267ecc1908cfd36a22a68b6f8da">” is to be read in accordance with Article 2(4) and (5).</ins></p></content></paragraph></article><article eId="article-2"><num>Article 2</num><heading>General requirements for applications and requests</heading><paragraph eId="article-2-1"><num>1.</num><content><p>The information and documentation submitted as part of an application or a request for the establishment of MRLs shall be accurate and conform to the current state of scientific knowledge and the scientific guidance issued by  <ins class="substitution first last" ukl:ChangeId="key-fdd827781fd25e8f5074be61addfcae0-1721225032789" ukl:CommentaryRef="key-fdd827781fd25e8f5074be61addfcae0"><noteRef uk:name="commentary" href="#key-fdd827781fd25e8f5074be61addfcae0" class="commentary"/>the appropriate authority</ins>  relating to the safety of residues.</p></content></paragraph><paragraph eId="article-2-2"><num>2.</num><content><p>An application or a request for the establishment of MRLs shall include any information relevant to the evaluation of the safety of residues of the substance concerned, whether favourable or unfavourable to the substance. Particular care shall be taken to ensure that there is adequate cross-referencing between volumes and between the detailed and critical summaries and the original data. Electronic submissions shall comply with guidance on veterinary e-Submissions published by the  <ins class="substitution first last" ukl:ChangeId="key-aac279d21f7631d519c1982edb45d412-1721224292219" ukl:CommentaryRef="key-aac279d21f7631d519c1982edb45d412"><noteRef uk:name="commentary" href="#key-aac279d21f7631d519c1982edb45d412" class="commentary"/>appropriate authority</ins>.</p></item><item><num>3.</num><p>Where reference is made to published information, complete copies of the relevant articles should be inserted in the relevant section of the dossier.</p></item><item><num>4.</num><p>The application or the request shall be submitted in accordance with the requirements specified below respecting the order of presentation indicated.</p></item><item><num>5.</num><p>Pharmacological, toxicological and residue tests, results of which are accompanying an application or a request for the establishment of MRLs, shall be carried out in conformity with Directive 2004/10/EC of the European Parliament and of the Council<authorialNote class="footnote" eId="f00002" marker="2"><p>Directive 2004/10/EC of the European Parliament and of the Council of 11 February 2004 on the harmonisation of laws, regulations and administrative provisions relating to the application of the principles of good laboratory practice and the verification of their applications for tests on chemical substances (<ref eId="c00002" p. 33</ref>).</p></authorialNote>.</p></item></blockList></intro><chapter eId="annex-chapter-1"><num>CHAPTER 1</num><heading><b>ADMINISTRATIVE INFORMATION</b></heading><content><p>The administrative information shall comprise two parts, one providing the administrative data and the second providing a summary of the evaluation proposed by the applicant/requestor.</p><p>The following details shall be included:</p><blockList class="unordered none" ukl:Name="UnorderedList" ukl:Decoration="none"><item><p>Part 1 — Administrative data:</p><blockList class="unordered dash" ukl:Name="UnorderedList" ukl:Decoration="dash"><item><p>name of the substance for review, using international non-proprietary name (INN) where attributed;</p></item><item><p>name and address of the applicant/requestor;</p></item><item><p>name and address details of the applicant/requestor contact point for all correspondence related to the application;</p></item></blockList></item><item><p>Part 2 — Summary of the evaluation proposed by the applicant/requestor:</p><blockList class="unordered dash" ukl:Name="UnorderedList" ukl:Decoration="dash"><item><p>name of the substance for review, using INN where attributed;</p></item><item><p>clarification on whether the substance is used in the product as active ingredient, excipient, preservative, etc.;</p></item><item><p>summary of anticipated pattern of veterinary use (target species, major indications, dose-regimen);</p></item><item><p>information on any applications to other Union or international bodies, the dates of these applications and the outcome;</p></item><item><p>summary of the findings:</p><blockList class="unordered dash" ukl:Name="UnorderedList" ukl:Decoration="dash"><item><p>relevant no-observed (adverse) effect levels (NO(A)EL) or an accepted alternative for the safety evaluation,</p></item><item><p>reference to relevant study,</p></item><item><p>uncertainty factor proposed,</p></item><item><p>Acceptable Daily Intake (ADI) proposed, or an alternative in accordance with Article 6 of Regulation (EC) No 470/2009,</p></item><item><p>marker residue (where relevant),</p></item><item><p>MRLs proposed (where relevant),</p></item><item><p>method of analysis proposed (including limit of quantification and reference, where relevant).</p></item></blockList></item></blockList></item></blockList></content></chapter><chapter eId="annex-chapter-2"><num>CHAPTER 2</num><heading><b>DATA FOR SCIENTIFIC RISK ASSESSMENT</b></heading><hcontainer name="division" eId="annex-chapter-2-division-A"><num>A.</num><heading><b>Safety file</b></heading><intro><p>The dossier of safety tests shall include the following documents:</p><blockList class="unordered dash" ukl:Name="UnorderedList" ukl:Decoration="dash"><item><p>an index of all studies included in the dossier,</p></item><item><p>a statement confirming that all data known to the applicant/requestor at the time of submission, whether favourable or unfavourable, are included,</p></item><item><p>a justification for the omission of any type of study,</p></item><item><p>an explanation for the inclusion of an alternative type of study,</p></item><item><p>in cases where a study pre-dates Directive 2004/10/EC or Good Laboratory Practice status is unknown, a discussion of the contribution that any non-GLP study can make to the overall risk assessment.</p></item></blockList><p>Each study report shall include the following documents:</p><blockList class="unordered dash" ukl:Name="UnorderedList" ukl:Decoration="dash"><item><p>a copy of the study plan (protocol, including amendments and deviations),</p></item><item><p>a signed statement of compliance with good laboratory practice, where applicable,</p></item><item><p>a description of the methods, apparatus and materials used,</p></item><item><p>a description and justification of the test system,</p></item><item><p>a description of the results obtained, in sufficient detail to allow the results to be critically evaluated independently of their interpretation by the author,</p></item><item><p>a statistical analysis of the results where appropriate,</p></item><item><p>a discussion of the results, with comment on observed (adverse) effect levels and NO(A)ELs, and on any unusual findings,</p></item><item><p>a detailed description and a thorough discussion of the results of the study.</p></item></blockList></intro><hcontainer name="division" eId="annex-chapter-2-division-A-division-A.0"><num>A.0.</num><heading>Detailed and critical summary</heading><content><p>The detailed and critical summary shall be signed and dated. Information about the author's educational background, training and occupational experience shall be attached. The professional relationship of the author with the applicant/requestor shall be declared.</p><p>All the important data shall be summarised in an Annex, in tabular or graphic form whenever possible and the relevant bibliographic references shall also be included in the Annexes to the document. The relevance of the studies provided for the evaluation of potential risks presented by residues to humans shall be addressed. The detailed and critical summary and its Annexes shall contain precise cross-references to the information contained in the main documentation. This section shall not introduce new studies that are not included in the main documentation.</p></content></hcontainer><hcontainer name="division" dossier;</p></item><item><p>a statement confirming that all data known to the applicant/requestor at the time of submission, whether favourable or unfavourable, are included;</p></item><item><p>a critical summary</p><p>The detailed and critical summary shall be signed and dated. Information about the author's educational background, training and occupational experience shall be attached. The professional relationship of the author with the applicant/requestor shall be declared.</p><p>All the important data shall be summarised in an Annex, in tabular or graphic form whenever possible and the relevant bibliographic references shall also be included in the Annexes to the document. The relevance for the studies provided for the establishment of maximum residue limits shall be discussed. The detailed and critical summary and the Annexes shall contain precise cross-references to the information contained in the main documentation.
