Annex II to Regulation (EU) No 1003/2010 is amended as follows:

   Whenever it is declared by the vehicle manufacturer that a vehicle is suitable for towing loads (point 2.11.5 of Annex I to Directive 2007/46/EC) and if the space for mounting the rear registration plate may as a result be (partly) obscured within the planes of geometrical visibility due to the permitted and/or recommended installation of any mechanical coupling device, this shall be noted in the test report and stated on the EC type-approval certificate. Regulation (EU) No 109/2011 is amended as follows:

1. (1)

   in Annex I, Part I, footnote (*) is deleted;

   ‘0.1.Category N and O vehicles, with the exception of off-road vehicles as defined in Annex II to Directive 2007/46/EC, shall be constructed and/or fitted with spray suppression systems in such a way as to meet the requirements laid down in this Annex. In the case of chassis/cab vehicles, these requirements may only be applied to the wheels covered by the cab.

   At the manufacturer's discretion, for vehicles of category N₁, N₂ with a permissible maximum laden mass not exceeding 7,5 tonnes, O₁ and O_2, the requirements of Commission Regulation (EU) No 1009/201046 as set out for vehicle category M₁ may be applied instead of the requirements of this Annex. In such a case, the information document shall include all the particulars relevant to wheel guards as laid down in Article 3(2) of that Regulation.’
