amending Regulation (EC) No 341/2007 as regards the import tariff quota for garlic originating in China

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EU) No 1308/2013 of the European Parliament and of the Council of 17 December 2013 establishing a common organisation of the markets in agricultural products and repealing Council Regulations (EEC) No 922/72, (EEC) No 234/79, (EC) No 1037/2001 and (EC) No 1234/20071, and in particular point (a) of Article 187 thereof,

Whereas:

Commission Regulation (EC) No 341/20072 opens and provides for the administration of tariff quotas for garlic and certain other agricultural products imported from third countries.

The Agreement in the form of an Exchange of Letters between the European Union and the People's Republic of China pursuant to Article XXIV:6 and Article XXVIII of the General Agreement on Tariffs and Trade (GATT) 1994 relating to the modification of concessions in the schedules of the Republic of Bulgaria and Romania in the course of their accession to the European Union3, approved by Council Decision 2014/116/EU4, provides for an increase of 12 375 tonnes to the allocation for People's Republic of China under the EU tariff rate quota for garlic.

The increase in the tariff rate quota should be reflected in Annex I to Regulation (EC) No 341/2007. Since the Agreement between the European Union and the People's Republic of China was approved by the Council on 28 January 2014, importers should have access to the increased quantities as from the second sub-period of the import tariff quota period 2014/2015.

Regulation (EC) No 341/2007 should therefore be amended accordingly.

The measures provided for in this Regulation are in accordance with the opinion of the Committee for the Common Organisation of the Agricultural Markets,

HAS ADOPTED THIS REGULATION:

Article 1Amendment to Regulation (EC) No 341/2007

Annex I to Regulation (EC) No 341/2007 is replaced by the text in the Annex to this Regulation.

Article 2Entry into force

This Regulation shall enter into force on the third day following that of its publication in the Official Journal of the European Union.

It shall apply from 1 July 2014.

This Regulation shall be binding in its entirety and directly applicable in all Member States.
