Article 10Duration and review of safeguard measures

1.

A safeguard measure shall remain in force only for such period of time as may be necessary to prevent or remedy the serious injury and to facilitate adjustment. That period shall not exceed 2 years, unless it is extended under paragraph 3.

A safeguard measure shall remain in force, pending the outcome of the review, during any extension period.

The initial period of duration of a safeguard measure may exceptionally be extended by up to 2 years provided it is determined that the safeguard measure continues to be necessary to prevent or remedy serious injury and to facilitate adjustment and that there is evidence that the Union industry is adjusting.

4.

Extensions shall be adopted in accordance with the procedures of this Regulation applying to investigations and using the same procedures as for the initial measures.

The total duration of a safeguard measure may not exceed 4 years, including any provisional measure.

5.

A safeguard measure shall not be applied beyond the expiry of the transition period, except with the consent of Korea.
