CHAPTER 1U.K.MARKETING STANDARDS

Article 1U.K.

The marketing standards applicable to bananas falling within CN code 0803 00, excluding plantains, fig bananas and bananas intended for processing, are laid down in Annex I.

Those marketing standards shall apply to bananas originating in third countries at the stage of release for free circulation [F1in Great Britain].

Article 2U.K.

The marketing standards referred to in Article 1 shall not affect the application, at later stages of marketing, of national rules which:

(a)

do not impede the free circulation of bananas F2... complying with the marketing standards referred to in Article 1; and

(b)

are not incompatible with the marketing standards referred to in Article 1.

1.For the purposes of this Regulation, ‘third country’ means any country or territory other than:

(a)the United Kingdom;

(b)the Bailiwick of Jersey;

(c)the Bailiwick of Guernsey;

(d)the Isle of Man.

2.For the purposes of this Regulation, ‘appropriate authority’ means:

(a)in relation to England, the Secretary of State;

(b)in relation to Wales, the Welsh Ministers;

(c)in relation to Scotland, the Scottish Ministers.

3.But the appropriate authority is the Secretary of State:

(a)in relation to Scotland, if consent is given by the Scottish Ministers.]
