amending Regulation (EC) No 2037/2000 of the European Parliament and of the Council as regards the adjustment of CN codes for certain ozone depleting substances and mixtures containing ozone depleting substances to take account of amendments to the Combined Nomenclature laid down in Council Regulation (EEC) No 2658/87

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Community,

Having regard to Regulation (EC) No 2037/2000 of the European Parliament and of the Council of 29 June 2000 on substances that deplete the ozone layer1 and in particular Article 6(5) thereof,

Whereas:

In the Combined Nomenclature for 2007, laid down in Council Regulation (EEC) No 2658/87 of 23 July 1987 on the tariff and statistical nomenclature and on the Common Customs Tariff2, as amended by Commission Regulation (EC) No 1549/20063, the combined nomenclature codes (CN codes) for certain products have been amended. Annex IV to Regulation (EC) No 2037/2000, relating to ozone depleting substances and mixtures containing ozone depleting substances, refers to some of those CN-codes. It is therefore necessary to adjust that Annex. In view of the many changes to be made, clarity requires it to be replaced in its entirety.

Regulation (EC) No 2037/2000 should therefore be amended accordingly.

Since Regulation (EC) No 1549/2006 entered into force on 1 January 2007, this Regulation should apply from the same date.

The measures provided for in this Regulation are in accordance with the opinion of the Committee established by Article 18(1) of Regulation (EC) No 2037/2000,
