Article 9Tunnels whose design has not yet been approved1.

Any tunnel whose design has not been approved by the responsible authority by 1 May 2006 shall be subject to the requirements of this Directive.

2.

The tunnel shall be commissioned in accordance with the procedure laid down in Annex II.
