                  <ref eId="c00009" href="https://webarchive.nationalarchives.gov.uk/eu-exit/https://eur-lex.europa.eu/legal-content/EN/TXT/?uri=uriserv:OJ.L_.1989.183.01.0001.01.ENG">OJ No L 183, 29. 6. 1989, p. 1</ref>.</p></authorialNote>; whereas the provisions of the latter are therefore fully applicable to the use by workers of display screen equipment, without prejudice to more stringent and/or specific provisions contained in the present Directive;</p><p>Whereas employers are obliged to keep themselves informed of the latest advances in technology and scientific findings concerning workstation design so that they can make any changes necessary so as to be able to guarantee a better level of protection of workers' safety and health;</p><p>Whereas the ergonomic aspects are of particular importance for a workstation with display screen equipment;</p><p>Whereas this Directive is a practical contribution towards creating the social dimension of the internal market;</p><p>Whereas, pursuant to Decision 74/325/EEC<authorialNote class="footnote" eId="f00007" marker="7"><p>
                  <ref eId="c00010" href="https://webarchive.nationalarchives.gov.uk/eu-exit/https://eur-lex.europa.eu/legal-content/EN/TXT/?uri=uriserv:OJ.L_.1974.185.01.0015.01.ENG">OJ No L 185, 9. 7. 1974, p. 15</ref>.</p></authorialNote>, the Advisory Committee on Safety, Hygiene and Health Protection at Work shall be consulted by the Commission on the drawing-up of proposals in this field,</p><p>HAS ADOPTED THIS DIRECTIVE:</p></preamble><body eId="body"><section eId="section-I"><num>SECTION I</num><heading>GENERAL PROVISIONS</heading><article eId="article-1"><num>Article 1</num><heading>Subject</heading><paragraph eId="article-1-1"><num>1.</num><content><p>This Directive, which is the fifth individual Directive within the meaning of Article 16 (1) of Directive 89/391/EEC, lays down minimum safety and health requirements for work with display screen equipment as defined in Article 2.</p></content></paragraph><paragraph eId="article-1-2"><num>2.</num><content><p>The provisions of Directive 89/391/EEC are fully applicable to the whole field referred to in paragraph 1, without prejudice to more stringent and/or specific provisions contained in the present Directive.</p></content></paragraph><paragraph eId="article-1-3"><num>3.</num><intro><p>This Directive shall not apply to:</p></intro><level class="para1"><num>(a)</num><content><p>drivers’ cabs or control cabs for vehicles or machinery;</p></content></level><level class="para1"><num>(b)</num><content><p>computer systems on board a means of transport;</p></content></level><level class="para1"><num>(c)</num><content><p>computer systems mainly intended for public use;</p></content></level><level class="para1"><num>(d)</num><content><p>‘portable’ systems not in prolonged use at a workstation;</p></content></level><level class="para1"><num>(e)</num><content><p>calculators, cash registers and any equipment having a small data or measurement display required for direct use of the equipment;</p></content></level><level class="para1"><num>(f)</num><content><p>typewriters of traditional design, of the type known as ‘typewriter with window’.</p></content></level></paragraph></article><article eId="article-2"><num>Article 2</num><heading>Definitions</heading><content><p>For the purpose of this Directive, the following terms shall have the following meanings:</p><blockList class="ordered alpha parens" ukl:Name="OrderedList" ukl:Type="alpha" ukl:Decoration="parens"><item><num>(a)</num><p>
                                 <i>display screen equipment</i>: an alphanumeric or graphic display screen, regardless of the display process employed;</p></item><item><num>(b)</num><p>
                                 <i>workstation</i>: an assembly comprising display screen equipment, which may be provided with a keyboard or input device and/or software determining the operator/machine interface, optional accessories, peripherals including the diskette drive, telephone, modem, printer, document holder, work chair and work desk or work surface, and the immediate work environment;</p></item><item><num>(c)</num><p>
                                 <i>worker</i>: any worker as defined in Article 3 (a) of Directive 89/391/EEC who habitually uses display screen equipment as a significant part of his normal work.</p></item></blockList></content></article></section><section eId="section-II"><num>SECTION II</num><heading>EMPLOYERS’ OBLIGATIONS</heading><article eId="article-3"><num>Article 3</num><heading>Analysis of workstations</heading><paragraph eId="article-3-1"><num>1.</num><content><p>Employers shall be obliged to perform an analysis of workstations in order to evaluate the safety and health conditions to which they give rise for their workers, particularly as regards possible risks to eyesight, physical problems and problems of mental stress.</p></content></paragraph><paragraph eId="article-3-2"><num>2.</num><content><p>Employers shall take appropriate measures to remedy the risks found, on the basis of the evaluation referred to in paragraph 1, taking account of the additional and/or combined effects of the risks so found.</p></content></paragraph></article><article eId="article-4"><num>Article 4</num><heading>Workstations put into service for the first time</heading><content><p>Employers must take the appropriate steps to ensure that workstations first put into service after 31 December 1992 meet the minimum requirements laid down in the Annex.</p></content></article><article eId="article-5"><num>Article 5</num><heading>Workstations already put into service</heading><content><p>Employers must take the appropriate steps to ensure that workstations already put into service on or before 31 December 1992 are adapted to comply with the minimum requirements laid down in the Annex not later than four years after that date.</p></content></article><article eId="article-6"><num>Article 6</num><heading>Information for, and training of, workers</heading><paragraph eId="article-6-1"><num>1.</num><content><p>Without prejudice to Article 10 of Directive 89/391/EEC, workers shall receive information on all aspects of safety and health relating to their workstation, in particular information on such measures applicable to workstations as are implemented under Articles 3, 7 and 9.</p><p>In all cases, workers or their representatives shall be informed of any health and safety measure taken in compliance with this Directive.</p></content></paragraph><paragraph eId="article-6-2"><num>2.</num><content><p>Without prejudice to Article 12 of Directive 89/391/EEC, every worker shall also receive training in use of the workstation before commencing this type of work and whenever the organization of the workstation is substantially modified.</p></content></paragraph></article><article eId="article-7"><num>Article 7</num><heading>Daily work routine</heading><content><p>The employer must plan the worker’s activities in such a way that daily work on a display screen is periodically interrupted by breaks or changes of activity reducing the workload at the display screen.</p></content></article><article eId="article-8"><num>Article 8</num><heading>Worker consultation and participation</heading><content><p>Consultation and participation of workers and/or their representatives shall take place in accordance with Article 11 of Directive 89/391/EEC on the matters covered by this Directive, including its Annex.</p></content></article><article eId="article-9"><num>Article 9</num><heading>Protection of workers’ eyes and eyesight</heading><paragraph eId="article-9-1"><num>1.</num><content><p>Workers shall be entitled to an appropriate eye and eyesight test carried out by a person with the necessary capabilities:</p><blockList class="unordered dash" ukl:Name="UnorderedList" ukl:Decoration="dash"><item><p>before commencing display screen work,</p></item><item><p>at regular intervals thereafter, and</p></item><item><p>if they experience visual difficulties which may be due to display screen work.</p></item></blockList></content></paragraph><paragraph eId="article-9-2"><num>2.</num><content><p>Workers shall be entitled to an ophthalmological examination if the results of the test referred to in paragraph 1 show that this is necessary.</p></content></paragraph><paragraph eId="article-9-3"><num>3.</num><content><p>If the results of the test referred to in paragraph 1 or of the examination referred to in paragraph 2 show that it is necessary and if normal corrective appliances cannot be used, workers must be provided with special corrective appliances appropriate for the work concerned.</p></content></paragraph><paragraph eId="article-9-4"><num>4.</num><content><p>Measures taken pursuant to this Article may in no circumstances involve workers in additional financial cost.</p></content></paragraph><paragraph eId="article-9-5"><num>5.</num><content><p>Protection of workers’ eyes and eyesight may be provided as part of a national health system.</p></content></paragraph></article></section><section eId="section-III"><num>SECTION III</num><heading>MISCELLANEOUS PROVISIONS</heading><article eId="article-10"><num><ins class="substitution first" ukl:ChangeId="O002001M001" ukl:CommentaryRef="c000002"><noteRef uk:name="commentary" href="#c000002" class="commentary"/>Article 10</ins></num><heading><ins class="substitution" ukl:ChangeId="O002001M001" ukl:CommentaryRef="c000002">Amendments to the Annex</ins></heading><content><p>
                        <ins class="substitution" ukl:ChangeId="O002001M001" ukl:CommentaryRef="c000002">The Commission is empowered to adopt delegated acts in accordance with Article 10a to make strictly technical amendments to the Annex, in order to take account of technical progress, developments in international regulations or specifications and knowledge in the field of display screen equipment.</ins>
                     </p><p>
                        <ins class="substitution" ukl:ChangeId="O002001M001" ukl:CommentaryRef="c000002">Where, in duly justified and exceptional cases involving imminent, direct and serious risks to workers’ and other persons’ physical health and safety, imperative grounds of urgency require action in a very short</ins>
                        <ins class="substitution last" ukl:ChangeId="O002001M001" ukl:CommentaryRef="c000002"> timeframe, the procedure provided for in Article 10b shall apply to delegated acts adopted pursuant to this Article.</ins>
                     </p></content></article><article eId="article-10a"><num><ins class="first" ukl:ChangeId="O002001M002" ukl:CommentaryRef="c000003"><noteRef uk:name="commentary" href="#c000003" class="commentary"/>Article 10a</ins></num><heading><ins ukl:ChangeId="O002001M002" ukl:CommentaryRef="c000003">Exercise of the delegation</ins></heading><paragraph eId="article-10a-1"><num><ins ukl:ChangeId="O002001M002" ukl:CommentaryRef="c000003">1.</ins></num><content><p>
                              <ins ukl:ChangeId="O002001M002" ukl:CommentaryRef="c000003">The power to adopt delegated acts is conferred on the Commission subject to the conditions laid down in this Article.</ins>
                           </p></content></paragraph><paragraph eId="article-10a-2"><num><ins ukl:ChangeId="O002001M002" ukl:CommentaryRef="c000003">2.</ins></num><content><p>
                              <ins ukl:ChangeId="O002001M002" ukl:CommentaryRef="c000003">The power to adopt delegated acts referred to in Article 10 shall be conferred on the Commission for a period of five years from </ins>
                              <ins ukl:ChangeId="O002001M002" ukl:CommentaryRef="c000003">26 July 2019</ins>
                              <ins ukl:ChangeId="O002001M002" ukl:CommentaryRef="c000003">. The Commission shall draw up a report in respect of the delegation of power not later than nine months before the end of the five-year period. The delegation of power shall be tacitly extended for periods of an identical duration, unless the European Parliament or the Council opposes such extension not later than three months before the end of each period.</ins>
                           </p></content></paragraph><paragraph eId="article-10a-3"><num><ins ukl:ChangeId="O002001M002" ukl:CommentaryRef="c000003">3.</ins></num><content><p>
                              <ins ukl:ChangeId="O002001M002" ukl:CommentaryRef="c000003">The delegation of power referred to in Article 10 may be revoked at any time by the European Parliament or by the Council. A decision to revoke shall put an end to the delegation of the power specified in that decision. It shall take effect the day following the publication of the decision in the </ins>

                              <ins ukl:ChangeId="O002001M002" ukl:CommentaryRef="c000003">As soon as it adopts a delegated act, the Commission shall notify it simultaneously to the European Parliament and to the Council.</ins>
                           </p></content></paragraph><paragraph eId="article-10a-6"><num><ins ukl:ChangeId="O002001M002" ukl:CommentaryRef="c000003">6.</ins></num><content><p>
                              <ins ukl:ChangeId="O002001M002" ukl:CommentaryRef="c000003">A delegated act adopted pursuant to Article 10 shall enter into force only if no objection has been expressed either by the European Parliament or the Council within a period of two months of notification of that act to the European Parliament and the Council or if, before the expiry of that period, the European Parliament and the Council have both informed the Commission that they will not object. That period shall be extended by two months at the initiative of the European Parliament or of the Council.</ins>
                           </p></content></paragraph></article><article eId="article-10b"><num><ins ukl:ChangeId="O002001M002" ukl:CommentaryRef="c000003">Article 10b</ins></num><heading><ins ukl:ChangeId="O002001M002" ukl:CommentaryRef="c000003">Urgency procedure</ins></heading><paragraph eId="article-10b-1"><num><ins ukl:ChangeId="O002001M002" ukl:CommentaryRef="c000003">1.</ins></num><content><p>
                              <ins ukl:ChangeId="O002001M002" ukl:CommentaryRef="c000003">Delegated acts adopted under this Article shall enter into force without delay and shall apply as long as no objection is expressed in accordance with paragraph 2. The notification of a delegated act to the European Parliament and the Council shall state the reasons for the use of the urgency procedure.</ins>
                           </p></content></paragraph><paragraph eId="article-10b-2"><num><ins ukl:ChangeId="O002001M002" ukl:CommentaryRef="c000003">2.</ins></num><content><p>
                              <ins ukl:ChangeId="O002001M002" ukl:CommentaryRef="c000003">Either the European Parliament or the Council may object to a delegated act in accordance with the procedure referred to in</ins>
                              <ins class="last" ukl:ChangeId="O002001M002" ukl:CommentaryRef="c000003"> Article 10a(6). In such a case, the Commission shall repeal the act immediately following the notification of the decision to object by the European Parliament or by the Council.</ins>
                           </p></content></paragraph></article><article eId="article-11"><num>Article 11</num><heading>Final provisions</heading><paragraph eId="article-11-1"><num>1.</num><content><p>Member States shall bring into force the laws, regulations and administrative provisions necessary to comply with this Directive by 31 December 1992.</p><p>They shall forthwith inform the Commission thereof.</p></content></paragraph><paragraph eId="article-11-2"><num>2.</num><content><p>Member States shall communicate to the Commission the texts of the provisions of national law which they adopt, or have already adopted, in the field covered by this Directive.</p></content></paragraph><paragraph eId="article-11-3"><num><noteRef States.</p></content></article></section><hcontainer name="schedules" eId="schedules"><hcontainer name="schedule" eId="annex"><num>ANNEX</num><heading>MINIMUM REQUIREMENTS</heading><heading>(Articles 4 and 5)</heading><hcontainer name="division" class="annotation" eId="annex-annotation-1"><heading>Preliminary remark</heading><content><p>The obligations laid down in this Annex shall apply in order to achieve the objectives of this Directive and to the extent that, firstly, the components concerned are present at the workstation, and secondly, the inherent requirements or characteristics of the task do not preclude it.</p></content></hcontainer><hcontainer name="division" eId="annex-division-1"><num>1.</num><heading>EQUIPMENT</heading><hcontainer name="division" eId="annex-division-1-division-a"><num>(a)</num><heading>General comment</heading><content><p>The use as such of the equipment must not be a source of risk for workers.</p></content></hcontainer><hcontainer name="division" eId="annex-division-1-division-b"><num>(b)</num><heading>Display screen</heading><content><p>The characters on the screen shall be well-defined and clearly formed, of adequate size and with adequate spacing between the characters and lines.</p><p>The image on the screen should be stable, with no flickering or other forms of instability.</p><p>The brightness and/or the contrast between the characters and the background shall be easily adjustable by the operator, and also be easily adjustable to ambient conditions.</p><p>The screen must swivel and tilt easily and freely to suit the needs of the operator.</p><p>It shall be possible to use a separate base for the screen or an adjustable table.</p><p>The screen shall be free of reflective glare and reflections liable to cause discomfort to the user.</p></content></hcontainer><hcontainer name="division" eId="annex-division-1-division-c"><num>(c)</num><heading>Keyboard</heading><content><p>The keyboard shall be tiltable and separate from the screen so as to allow the worker to find a comfortable working position avoiding fatigue in the arms or hands.</p><p>The space in front of the keyboard shall be sufficient to provide support for the hands and arms of the operator.</p><p>The keyboard shall have a matt surface to avoid reflective glare.</p><p>The arrangement of the keyboard and the characteristics of the keys shall be such as to facilitate the use of the keyboard.</p><p>The symbols on the keys shall be adequately contrasted and legible from the design working position.</p></content></hcontainer><hcontainer name="division" eId="annex-division-1-division-d"><num>(d)</num><heading>Work desk or work surface</heading><content><p>The work desk or work surface shall have a sufficiently large, low-reflectance surface and allow a flexible arrangement of the screen, keyboard, documents and related equipment.</p><p>The document holder shall be stable and adjustable and shall be positioned so as to minimize the need for uncomfortable head and eye movements.</p><p>There shall be adequate space for workers to find a comfortable position.</p></content></hcontainer><hcontainer name="division" eId="annex-division-1-division-e"><num>(e)</num><heading>Work chair</heading><content><p>The work chair shall be stable and allow the operator easy freedom of movement and a comfortable position.</p><p>The seat shall be adjustable in height.</p><p>The seat back shall be adjustable in both height and tilt.</p><p>A footrest shall be made available to any one who wishes for one.</p></content></hcontainer></hcontainer><hcontainer name="division" eId="annex-division-2"><num>2.</num><heading>ENVIRONMENT</heading><hcontainer name="division" eId="annex-division-2-division-a"><num>(a)</num><heading>Space requirements</heading><content><p>The workstation shall be dimensioned and designed so as to provide sufficient space for the user to change position and vary movements.</p></content></hcontainer><hcontainer name="division" eId="annex-division-2-division-b"><num>(b)</num><heading>Lighting</heading><content><p>Room lighting and/or spot lighting (work lamps) shall ensure satisfactory lighting conditions and an appropriate contrast between the screen and the background environment, taking into account the type of work and the user’s vision requirements.</p><p>Possible disturbing glare and reflections on the screen or other equipment shall be prevented by coordinating workplace and workstation layout with the positioning and technical characteristics of the artificial light sources.</p></content></hcontainer><hcontainer name="division" eId="annex-division-2-division-c"><num>(c)</num><heading>Reflections and glare</heading><content><p>Workstations shall be so designed that sources of light, such as windows and other openings, transparent or translucid walls, and brightly coloured fixtures or walls cause no direct glare <ins class="substitution first last" ukl:ChangeId="O001001M002" ukl:CommentaryRef="c000005"><noteRef uk:name="commentary" href="#c000005" class="commentary"/>and no distracting reflections on the screen</ins>.</p><p>Windows shall be fitted with a suitable system of adjustable covering to attenuate the daylight that falls on the workstation.</p></content></hcontainer><hcontainer name="division" eId="annex-division-2-division-d"><num>(d)</num><heading>Noise</heading><content><p>Noise emitted by equipment belonging to workstation(s) shall be taken into account when a workstation is being equipped, in particular so as not to distract attention or disturb speech.</p></content></hcontainer><hcontainer name="division" eId="annex-division-2-division-e"><num>(e)</num><heading>Heat</heading><content><p>Equipment belonging to workstation(s) shall not produce excess heat which could cause discomfort to workers.</p></content></hcontainer><hcontainer name="division" eId="annex-division-2-division-f"><num>(f)</num><heading>Radiation</heading><content><p>All radiation with the exception of the visible part of the electromagnetic spectrum shall be reduced to negligible levels from the point of view of the protection of workers’ safety and health.</p></content></hcontainer><hcontainer name="division" eId="annex-division-2-division-g"><num>(g)</num><heading>Humidity</heading><content><p>An adequate level of humidity shall be established and maintained.</p></content></hcontainer></hcontainer><hcontainer name="division" eId="annex-division-3"><num>3.</num><heading>OPERATOR/COMPUTER INTERFACE</heading><content><p>In designing, selecting, commissioning and modifying software, and in designing tasks using display screen equipment, the employer shall take into account the following principles:</p><blockList class="ordered alpha parens" ukl:Name="OrderedList" ukl:Type="alpha" ukl:Decoration="parens"><item><num>(a)</num><p>software must be suitable for the task;</p></item><item><num>(b)</num><p>software must be easy to use and, where appropriate, adaptable to the operator’s level of knowledge or experience; no quantitative or qualitative checking facility may be used without the knowledge of the workers;</p></item><item><num>(c)</num><p>systems must provide feedback to workers on their performance;</p></item><item><num>(d)</num><p>systems must display information in a format and at a pace which are adapted to operators;</p></item><item><num>(e)</num><p>the principles of software ergonomics must be applied, in particular to human data processing.</p></item></blockList></content></hcontainer></hcontainer></hcontainer></body></act></akomaNtoso>
