               <inline name="uppercase">Council Decision</inline> 2014/727/CFSP</p><p>of 20 October 2014</p><p>amending Decision 2011/137/CFSP concerning restrictive measures in view of the situation in Libya</p></longTitle></preface><preamble><p>THE COUNCIL OF THE EUROPEAN UNION,</p><p>Having regard to the Treaty on European Union, and in particular Article 29 thereof,</p><p>Whereas:</p><blockContainer class="division" uk:name="division"><num>(1)</num><p>On 28 February 2011, the Council adopted Decision 2011/137/CFSP<authorialNote class="footnote" eId="f00001" marker="1"><p>Council Decision 2011/137/CFSP of 28 February 2011 concerning restrictive measures in view of the situation in Libya (<ref eId="c00001" href="https://webarchive.nationalarchives.gov.uk/eu-exit/https://eur-lex.europa.eu/legal-content/EN/TXT/?uri=uriserv:OJ.L_.2011.058.01.0053.01.ENG">OJ L 58, 3.3.2011, p. 53</ref>).</p></authorialNote>.</p></blockContainer><blockContainer class="division" uk:name="division"><num>(2)</num><p>On 27 June 2014, the Sanctions Committee established pursuant to United Nations Security Council Resolution (‘UNSCR’) 1970 (2011) concerning Libya updated the list of individuals and entities subject to restrictive measures. The lists set out in Annexes I and III to Decision 2011/137/CFSP should therefore be amended accordingly.</p></blockContainer><blockContainer class="division" uk:name="division"><num>(3)</num><p>On 27 August 2014, the United Nations Security Council adopted UNSCR 2174 (2014), extending the application of the travel ban and asset freeze measures as set out in paragraph 22 of UNSCR 1970 (2011) and paragraph 23 of UNSCR 1973 (2011).</p></blockContainer><blockContainer class="division" uk:name="division"><num>(4)</num><p>In addition, UNSCR 2174 (2014) amends the scope of the arms embargo imposed by paragraph 9 of UNSCR 1970 (2011), paragraph 13 of UNSCR 2009 (2011) and paragraphs 9 and 10 of UNSCR 2095 (2013). It is therefore necessary to amend Decision 2011/137/CFSP in order to further clarify the scope of the arms embargo.</p></blockContainer><blockContainer class="division" uk:name="division"><num>(5)</num><p>Decision 2011/137/CFSP should therefore be amended accordingly.</p></blockContainer><blockContainer class="division" uk:name="division"><num>(6)</num><p>Further action by the Union is needed in order to implement certain of these amendments,</p></blockContainer><p>HAS ADOPTED THIS DECISION:</p></preamble><body eId="body"><article eId="article-1"><num>Article 1</num><content><p>Decision 2011/137/CFSP is hereby amended as follows:</p><blockList class="ordered arabic parens" ukl:Name="OrderedList" ukl:Type="arabic" ukl:Decoration="parens"><item><num>(1)</num><p>Article 2 is replaced by the following:</p><p><mod><quotedStructure startQuote="‘" endQuote="’" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="single"><article><num>Article 2</num><paragraph><num>1.</num><intro><p>Article 1 shall not apply to:</p></intro><level class="para1"><num>(a)</num><content><p>the supply, sale or transfer of non-lethal military equipment or of equipment which might be used for internal repression, intended solely for humanitarian or protective use;</p></content></level><level class="para1"><num>(b)</num><content><p>the provision of technical assistance, training or other assistance, including personnel, related to such equipment;</p></content></level><level class="para1"><num>(c)</num><content><p>the provision of financial assistance related to such equipment.</p></content></level></paragraph><paragraph><num>2.</num><intro><p>Article 1 shall not apply to:</p></intro><level class="para1"><num>(a)</num><content><p>the supply, sale or transfer of arms and related materiel;</p></content></level><level class="para1"><num>(b)</num><content><p>the provision of technical assistance, training or other assistance, including personnel, related to such equipment;</p></content></level><level class="para1"><num>(c)</num><content><p>the provision of financial assistance related to such equipment,</p></content></level><wrapUp><p>as approved in advance by the Committee established pursuant to paragraph 24 of UNSCR 1970 (2011) (“the Committee”).</p></wrapUp></paragraph><paragraph><num>3.</num><content><p>Article 1 shall not apply to the supply, sale or transfer of small arms, light weapons and related materiel, temporarily exported to Libya for the sole use of United Nations (UN) personnel, representatives of the media and humanitarian and development workers and associated personnel, notified to the Committee in advance and in the absence of a negative decision by the Committee within five working days of such a notification.</p></content></paragraph><paragraph><num>4.</num><content><p>Article 1 shall not apply to the supply, sale or transfer of non-lethal military equipment intended solely for security or disarmament assistance to the Libyan government, as well as the provision of related technical assistance, training or financial assistance.</p></content></paragraph><paragraph><num>5.</num><content><p>Article 1 shall not apply to the supply, sale or transfer of protective clothing, including flak jackets and military helmets, temporarily exported to Libya by UN personnel, personnel of the Union or its Member States, representatives of the media and humanitarian and development workers and associated personnel for their personal use only.</p></content></paragraph><paragraph><num>6.</num><content><p>Article 1 shall not apply to the supply, sale or transfer of non-lethal military equipment intended solely for humanitarian or protective use, and related technical assistance or training.</p></content></paragraph></article></quotedStructure><inline
