               <Text>THE COUNCIL OF THE EUROPEAN UNION,</Text>
            </P>
            <P>
               <Text>Having regard to the Treaty on the Functioning of the European Union, and in particular point (a) of Article 77(2), in conjunction with Article 218(5), thereof,</Text>
            </P>
            <P>
               <Text>Having regard to the proposal from the European Commission,</Text>
            </P>
            <P>
               <Text>Whereas:</Text>
            </P>
            <Division>
               <Number>(1)</Number>
               <P>
                  <Text>The Agreement between the European Community and the Republic of Moldova on the facilitation of the issuance of visas<FootnoteRef Ref="f00001"/> entered into force on 1 January 2008.</Text>
               </P>
            </Division>
            <Division>
               <Number>(2)</Number>
               <P>
                  <Text>On 11 April 2011, the Council authorised the Commission to open negotiations with the Republic of Moldova on amendments to that Agreement between the European Community and the Republic of Moldova on the facilitation of the issuance of visas. The negotiations were successfully concluded by the initialling of an Agreement between the European Union and the Republic of Moldova amending the Agreement between the European Community and the Republic of Moldova on the facilitation of the issuance of visas (‘the Agreement’) on 22 March 2012.</Text>

               <Number>(3)</Number>
               <P>
                  <Text>The Agreement should be signed subject to its conclusion.</Text>
               </P>
            </Division>

               <Number>(4)</Number>
               <P>
                  <Text>This Decision constitutes a development of the provisions of the Schengen <Emphasis>acquis</Emphasis> in which the United Kingdom does not take part, in accordance with Council Decision 2000/365/EC of 29 May 2000 concerning the request of the United Kingdom of Great Britain and Northern Ireland to take part in some of the provisions of the Schengen <Emphasis>acquis</Emphasis>
                     <FootnoteRef Ref="f00002"/>; the United Kingdom is therefore not taking part in its adoption and is not bound by it or subject to its application.</Text>

               <Number>(5)</Number>
               <P>
                  <Text>This Decision constitutes a development of the provisions of the Schengen <Emphasis>acquis</Emphasis> in which Ireland does not take part, in accordance with Council Decision 2002/192/EC of 28 February 2002 concerning Ireland's request to take part in some of the provisions of the Schengen <Emphasis>acquis</Emphasis>
