THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Council Directive 89/106/EEC of 21 December 1988 on the approximation of laws, regulations and administrative provisions of the Member States relating to construction products1, and in particular Article 13(4)(a) thereof,

After consulting the Standing Committee on Construction,

Whereas:

On 25 January 1999, the Commission adopted Decision 1999/94/EC on the procedure for attesting the conformity of construction products pursuant to Article 20(2) of Council Directive 89/106/EEC as regards precast normal/lightweight/autoclaved aerated concrete products2.

(2)

Annex III to Decision 1999/94/EC should be amended in order to adapt the systems of attestation of conformity for beam/block floor units and elements incorporating organic material to technical progress in order to take into account uses subject to regulations on reaction to fire, as a different level of third party intervention should be ensured depending on the processes and materials used in production.

(3)

Decision 1999/94/EC should therefore be amended accordingly,
