               <inline name="uppercase">Council Decision</inline> 2011/706/CFSP</p><p>of 27 October 2011</p><p>amending Decision 2010/638/CFSP concerning restrictive measures against the Republic of Guinea</p></longTitle></preface><preamble><p>THE COUNCIL OF THE EUROPEAN UNION,</p><p>Having regard to the Treaty on European Union, and in particular Article 29 thereof,</p><p>Whereas:</p><blockContainer class="division" uk:name="division"><num>(1)</num><p>On 25 October 2010, the Council adopted Decision 2010/638/CFSP<authorialNote class="footnote" eId="f00001" marker="1"><p>

                  <ref eId="c00003" href="https://webarchive.nationalarchives.gov.uk/eu-exit/https://eur-lex.europa.eu/legal-content/EN/TXT/?uri=uriserv:OJ.L_.2011.076.01.0059.01.ENG">OJ L 76, 22.3.2011, p. 59</ref>.</p></authorialNote>, amending Decision 2010/638/CFSP in the light of the political situation and of the Report of the International Commission of Inquiry mandated to establish the facts and circumstances of the events of 28 September 2009 in Guinea.</p></blockContainer><blockContainer class="division" uk:name="division"><num>(3)</num><p>On the basis of a review of Decision 2010/638/CFSP, those restrictive measures should be extended until 27 October 2012.</p></blockContainer><blockContainer class="division" uk:name="division"><num>(4)</num><p>Furthermore, it is necessary to amend the measures provided for in Decision 2010/638/CFSP regarding military equipment and equipment which might be used for internal repression.</p></blockContainer><blockContainer class="division" uk:name="division"><num>(5)</num><p>Decision 2010/638/CFSP should be amended accordingly,</p></blockContainer><p>HAS ADOPTED THIS DECISION:</p></preamble><body eId="body"><article eId="article-1"><num>Article 1</num><content><p>Decision 2010/638/CFSP is hereby amended as follows:</p><blockList class="ordered arabic parens" ukl:Name="OrderedList" ukl:Type="arabic" ukl:Decoration="parens"><item><num>(1)</num><p>Article 2(1) is replaced by the following:</p><p><mod><quotedStructure startQuote="‘" endQuote="’" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="single"><paragraph><num>1.</num><intro><p>Article 1 shall not apply to the:</p></intro><level class="para1"><num>(a)</num><content><p>sale, supply, transfer or export of non-lethal military equipment or of equipment which might be used for internal repression, intended solely for humanitarian or protective use, or for institution building programmes of the United Nations (UN) and of the Union, or for Union and UN crisis management operations;</p></content></level><level class="para1"><num>(b)</num><content><p>sale, supply, transfer or export of non-lethal military equipment or of non-lethal equipment which might be used for internal repression, intended solely to enable the police and gendarmerie of the Republic of Guinea to use only appropriate and proportionate force while maintaining public order;</p></content></level><level class="para1"><num>(c)</num><content><p>sale, supply, transfer or export of non-combat vehicles which have been manufactured or fitted with materials to provide ballistic protection, intended solely for the protective use of the personnel of the Union and its Member States in the Republic of Guinea;</p></content></level><level class="para1"><num>(d)</num><content><p>provision of technical assistance, brokering services and other services related to the items referred to in (a) to (c) or to the programmes and operations referred to in (a);</p></content></level><level class="para1"><num>(e)</num><content><p>provision of financing and financial assistance related to the items referred to in (a) to (c) or to the programmes and operations referred to in (a);</p></content></level><wrapUp><p>on condition that such exports and assistance have been approved in advance by the relevant competent authority.</p></wrapUp></paragraph></quotedStructure><inline name="appendText">;</inline></mod></p></item><item><num>(2)</num><p>Article 8(2) is replaced by the following:</p><p><mod><quotedStructure startQuote="‘" endQuote="’" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="single"><paragraph><num>2.</num><content><p>This Decision shall apply until 27 October 2012. It shall be kept under constant review.
