of 3 May 2011

(2011/267/EU)
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Whereas:
Directive 92/65/EEC lays down conditions applicable to imports of animals, semen, ova and embryos. Those conditions are to be at least equivalent to those applicable to trade between Member States.
Directive 2009/156/EC lays down animal health conditions for the movement between Member States and importation from third countries of live equidae. Pursuant to that Directive, equidae must come from third countries which are free from African horse sickness.
That situation is liable to constitute a serious animal health risk for the equine population in the Union and, therefore, the temporary admission of registered horses and the imports into the Union of such horses and of semen collected from registered horses from the Metropolitan area of Cape Town should be suspended.
Decision 2004/211/EC should therefore be amended accordingly.
The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on the Food Chain and Animal Health,
