amending Decision 2009/379/EC setting the amounts which, pursuant to Council Regulations (EC) No 1782/2003, (EC) No 378/2007, (EC) No 479/2008 and (EC) No 73/2009 are made available to the EAFRD and the amounts available for EAGF expenditure

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Council Regulation (EC) No 1290/2005 of 21 June 2005 on the financing of the common agricultural policy1, and in particular Article 12(2) and (3) thereof,

Whereas:

Commission Decision 2009/379/EC2 sets the amounts which, pursuant to Articles 10(2) and 143d of Council Regulation (EC) No 1782/20033, Article 4(1) of Council Regulation (EC) No 378/20074, Article 190a of Council Regulation (EC) No 1234/20075 and Articles 9(1), 10(3), 134 and 135 of Council Regulation (EC) No 73/20096, are made available to the European Agricultural Fund for Rural Development (EAFRD), as well as the amounts available for the European Agricultural Guarantee Fund (EAGF) expenditure.

Commission Decision 2009/780/EC of 22 October 2009 fixing the net amounts resulting from the application of voluntary modulation in Portugal for calendar years 2010, 2011 and 20127 has been repealed by Commission Decision 2010/235/EU8 in order to take into account the decision taken by Portugal not to apply voluntary modulation at all.

Decision 2009/1005/EU of the European Parliament and of the Council9 as regards the financing of the European Economic Recovery Plan has further reduced the net amount available for EAGF expenditure in line with the provisions of Article 12(1) of Council Regulation (EC) No 1290/2005.

Decision 2009/379/EC should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Sole Article

The Annex to Decision 2009/379/EC is amended in accordance with the Annex to this Decision.
