This Decision lays down certain transitional measures to be applied in a Member State where outbreaks of avian influenza caused by highly pathogenic avian influenza (HPAI) viruses are suspected or confirmed in poultry or other captive birds.

Without prejudice to the measures to be applied on holdings, and in protection and surveillance zones in accordance with Directive 92/40/EEC the measures provided for in this Decision shall be applied by Member States that have not fully transposed the provisions of Directive 2005/94/EC concerned by this Decision.
