The Secretary of State for Transport makes this Order in exercise of powers conferred by section 10 of the Highways Act 1980(1), and now vested in him(2), and of all other enabling powers:

1.  The lengths of the highways described in the Schedule to this Order and shown by broad striped hatching on the deposited plan shall become trunk roads as from the date on which the Secretary of State notifies the County Council of Warwickshire and the County Council of Hereford and Worcester that the new trunk roads are open for through traffic.

2.  In this Order—

(1) all measurements of distance are measured along the route of the relevant highways;

(2) (i) “the deposited plan”

means the plan contained in the folio numbered HA 10/2 WMRO(L) XLVI marked the Worcester — Banbury Principal Road (A422) (South and East of Alcester) Trunking Order 1987 signed by authority of the Secretary of State and deposited at the Department of Transport, Romney House, 43 Marsham Street, London SW1P 3PY;

(ii)“the new trunk roads”

means the trunk roads to be constructed by the Secretary of State in pursuance of the Bath — Lincoln Trunk Road (Alcester Bypasses A435/A422) Order 1987(3);

(iii)“the Stratford-upon-Avon Northern Bypass”

means the trunk road to be constructed by the Secretary of State in pursuance of the Bath — Lincoln Trunk Road (Stratford-upon-Avon Northern Bypass) Order 1984(4);

(iv)“the A435”

means the Evesham — Birmingham Principal Road;

(v)“the A422”

means the Worcester — Banbury Principal Road;

3.  This Order shall come into force on 21st January 1988 and may be cited as the Worcester — Banbury Principal Road (A422) (South and East of Alcester) Trunking Order 1987.

SCHEDULE

The lengths of the highways which are to become trunk roads are as follows:

(i)the A422 from a point approximately 275 metres north of Arrow church south-westwards to its junction with the A435 at Arrow in the County of Warwickshire, a distance of approximately 0.38 kilometres, and marked “A” on the deposited plan.

(ii)the A422 from its junction with Haselor Road (C46) in the County of Warwickshire generally eastwards to its junction with the Stratford-upon-Avon Northern Bypass, a distance of approximately 5.22 kilometres, and marked “B” on the deposited plan.
