The National Assembly for Wales makes the following Regulations in exercise of the powers conferred upon it by sections 29 and 126(4) of the National Health Service Act 1977(1), and of all other powers enabling it in that behalf:mdash;

Citation, commencement, interpretation and application

1.—(1) These Regulations may be cited as the National Health Service (General Medical Services) Amendment (No.2) (Wales) Regulations 2000 and shall come into force on 1st August 2000.

(2) In these Regulations, “the 1992 Regulations” means the National Health Service (General Medical Services) Regulations 1992(2).

(3) These Regulations shall apply to Wales only.

Amendment of the 1992 Regulations

2.  In Regulation 34(2) of the1992 Regulations (payments), for sub-paragraph (e) shall be substituted –

(e)allowances for study leave;.

Explanatory Note

(This note does not form part of the Regulations)

These Regulations further amend the National Health Service (General Medical Services) Regulations 1992 (“the 1992 Regulations”), which regulate the terms on which General Medical Services are provided under the National Health Service Act 1977.

Regulation 34 of the 1992 Regulations makes provision at paragraph (1) for a Health Authority to make payments, in accordance with the rates and conditions determined by the National Assembly, to doctors who provide General Medical Services in its area.

From August 2000 vocational training for General Practitioners will no longer be funded from a Health Authority’s General Medical Services budget. Thereafter, a Health Authority will make payments in respect of allowances for training for General Practitioners in accordance with directions to Health Authorities concerning General Practice Registrars.

Accordingly, regulation 34(2) of the 1992 Regulations is amended to remove the reference to allowances for training doctors from the matters for which provision shall be made under paragraph (1) of that regulation.

Section 126(4) was amended by the 1990 Act, section 65(2); and (in England) by the Health Act 1999 (c. 8), Schedule 4, paragraph 37(6). The functions of the Secretary of State under sections 29 and 126(4) of the 1977 Act were transferred to the National Assembly for Wales under article 2 of, and Schedule 1 to, the National Assembly for Wales (Transfer of Functions) Order 1999, S.I. 1999/672.
