(This note is not part of the Regulations)
These Regulations are made under the Armed Forces Act 2006 (c. 52) and amend the Royal Air Force Terms of Service Regulations 2007 (S.I. 2007/650).
Regulation 2 provides for a new type of engagement, which enables persons who have reached the age of 17 years and 42 weeks to be enlisted for a term of air force service of between 12 and 24 months. Those who have enlisted on such an engagement have the right under this regulation, after the expiration of 6 months from their date of enlistment, to be discharged from air force service with no reserve liability by providing 28 days’ written notice to their commanding officer. A person on a foundation engagement may be treated as if they had enlisted on a notice engagement where written approval of the competent air force authority is obtained.
A full impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sector is foreseen.
2006 c. 52. There are amendments to section 329 which are not relevant to these Regulations. See section 328(5) for the definition of “prescribed”. The Defence Council is treated as if it were a Minister of the Crown for the purposes of the Statutory Instruments Act 1946 (c. 36) by virtue of section 373(2) of the Armed Forces Act 2006.
S.I. 2007/650; relevant amending instruments are S.I. 2014/3068 and 2024/1059.
