The Secretary of State, in exercise of the powers conferred by sections 176(1) and (2) and 272(7) and (8) of the National Health Service Act 2006(1), makes the following Regulations.
1.—(1) These Regulations may be cited as the National Health Service (Dental Charges) (Amendment) Regulations 2023 and come into force on 24th April 2023.
(2) These Regulations extend to England and Wales and apply in relation to England only.
2.—(1) The National Health Service (Dental Charges) Regulations 2005(2) are amended as follows.
(2) In regulation 4 (calculation of charges)—
(a)in paragraphs (1) and (5), for “£23.80” substitute “£25.80”;
(b)in paragraph (2), for “£65.20” substitute “£70.70”;
(c)in paragraphs (3) and (4), for “£282.80” substitute “£306.80”.

These Regulations amend the National Health Service (Dental Charges) Regulations 2005 (“the 2005 Regulations”). The 2005 Regulations include patient charges levied for NHS dental treatments in England.
Regulation 2 amends regulation 4 of the 2005 Regulations to increase the charges for dental treatments. Regulation 2(2)(a) amends paragraphs (1) and (5) of regulation 4 of the 2005 Regulations to increase the charge payable for Band 1 courses of treatment, including for urgent treatments, from £23.80 to £25.80. Regulation 2(2)(b) amends regulation 4(2) of the 2005 Regulations to increase the charge payable for Band 2 courses of treatment from £65.20 to £70.70. Regulation 2(2)(c) amends paragraphs (3) and (4) of regulation 4 of the 2005 Regulations to increase the charge payable for Band 3 courses of treatment, including the supply of dental appliances, from £282.80 to £306.80.

2006 c. 41. Section 176 was amended by section 55(1) of, and paragraph 94(b) of Schedule 4 to, the Health and Social Care Act 2012 (c. 7) and by section 1(2) of, and paragraph 1(1) and (2) of Schedule 1 to, the Health and Care Act 2022 (c. 31). By virtue of section 271(1) of the National Health Service Act 2006, the powers being exercised by the Secretary of State in the making of these Regulations are exercisable only in relation to England.
