Coming into force in accordance with article 1

The Secretary of State, in exercise of the powers conferred by sections 114(1), 115(2), 116(3) and 117(5)(4) of, and Schedule 5C(5) to, the Local Democracy, Economic Development and Construction Act 2009(6) (“the 2009 Act”), makes the following Order.

A draft of this instrument has been laid before, and approved by a resolution of, each House of Parliament pursuant to section 117(2) of the 2009 Act(7).

2009 c. 20. Section 114 was amended by paragraph 26(2) to (4) of Schedule 5 to the Cities and Local Government Devolution Act 2016 (c. 1) and by S.I. 2016/997.

Section 115 was amended by paragraph 27 of Schedule 5 to the Cities and Local Government Devolution Act 2016.

Section 116 was amended by paragraph 28 of Schedule 5 to the Cities and Local Government Devolution Act 2016 and by S.I. 2016/997.

Section 117(5) was amended by paragraph 29 of Schedule 5 to the Cities and Local Government Devolution Act 2016.

Schedule 5C was inserted by section 4 of, and paragraph 1 of Schedule 2 to, the Cities and Local Government Devolution Act 2016. Schedule 5C applies where an Order is made under section 107F of the 2009 Act providing for the mayor to exercise the powers of a police and crime commissioner. Such an Order has been made in relation to Greater Manchester (S.I. 2016/448).

Sections 107A and 107F and Schedule 5B were inserted by sections 2 and 4 of, and paragraph 1 of Schedule 1 to, the Cities and Local Government Devolution Act 2016.

Section 117(2), (2A) and (3) were substituted by section 13 of the Localism Act 2011 (c. 20). Section 117 was amended by paragraph 29 of Schedule 5 to the Cities and Local Government Devolution Act 2016.
