The Secretary of State makes these Regulations in exercise of the powers conferred by sections 15(1), (2), (3)(a), (4)(a), (5)(a) and (b), (6)(b), (9) and 52(2) of, and paragraphs 15(1), 16 and 20 of Schedule 3 to, the Health and Safety at Work etc. Act 1974 M1 (“the 1974 Act”).
The Regulations give effect without modification to proposals submitted to the Secretary of State by the Health and Safety Executive (“the Executive”) under section 11(3) of the 1974 Act M2.
Before submitting those proposals to the Secretary of State, the Executive consulted the bodies that appeared to it to be appropriate as required by section 50(3) of the 1974 Act M3.

M11974 c.37; section 15(1) was inserted by the Employment Protection Act 1975 (c.71), Schedule 15, paragraph 6; section 15(4)(a) was amended by S.I. 2008/960; the general purposes of Part I referred to in section 15 of the 1974 Act, and the effect of that Part, were extended by section 1(1) of the Offshore Safety Act 1992 (c.15) and by section 117(1) and (2) of the Railways Act 1993 (c.43).
