The A38 Trunk Road (Weeford, Staffordshire to Minworth, Birmingham) (Detrunking) Order 2008

The Secretary of State for Transport makes this Order in exercise of powers conferred by sections 10 and 12 of the Highways Act 1980 (1) and now vested in him (2)-

1.  This Order may be cited as the A38 Trunk Road (Weeford, Staffordshire to Minworth, Birmingham) (Detrunking) Order 2008 and shall come into force on 26th February 2009.

2.  In this Order –

(i)“the plan” means the plan folio numbered HA 10/NOD/001 marked “The A38 Trunk Road (Weeford, Staffordshire to Minworth, Birmingham) (Detrunking) Order 2008” signed by the authority of the Secretary of State for Transport and deposited at the Department for Transport, Information Management Division, Ashdown House, Sedlescombe Road North, St Leonards-on-Sea, East Sussex TN37 7GA;

(ii)“principal road” as a classification for a highway, means that the highway is a principal road for the purposes of enactments and instruments which refer to highways classified as principal roads and is also classified for the purpose of every other enactment and instrument which refers to highways classified by the Secretary of State; and

(iii)“the trunk road” means the A38 Trunk Road

3.  The length of the trunk road described in the Schedule to this Order shall cease to be a trunk road and shall be classified as a principal road from the date on which the Order comes into force.

THE SCHEDULELENGTH OF THE TRUNK ROAD CEASING TO BE A TRUNK ROAD

The lengths of road ceasing to be trunk road are situated;

i)between the southern boundary of its roundabout junction with the A5 at Weeford, excluding the circulatory carriageway of that roundabout (marked `A' on the plan), and the County Boundary of Staffordshire and Warwickshire at Bassetts Pole (marked `B' on the plan), a distance of 5.9km, all in the County of Staffordshire;

ii)between the County Boundary of Staffordshire and Warwickshire (marked `B' on the plan), and the northern boundary of its roundabout junction with M6 Toll Motorway at Langley Mill North approximately 1.3km south of Bassetts Pole, excluding the circulatory carriageway of that roundabout (marked `C' on the plan), a distance of approximately 1.2km all in the County of Warwickshire;

iii)between the southern boundary of its roundabout junction with the M6Toll Motorway at Langley Mill South, excluding the circulatory carriageway of that roundabout (marked `D' on the plan) and the Boundary of the County of Warwickshire and the City of Birmingham (marked `E' on the plan), a distance of approximately 0.4km, all in the county of Warwickshire;

iv)between the boundary of the County of Warwickshire and the City of Birmingham (marked `E' on the plan) and its roundabout junction with the A4097 and Lindridge Drive at Minworth, including the circulatory carriageway (marked `F' on the plan), a distance of approximately 4.1km, all in the City of Birmingham;

Explanatory Note

(This note is not part of the Order)

This Order reclassifies the length of the road situated between Weeford Island, Staffordshire to Langley Mill North Island, Warwickshire and recommencing from Langley Mill South Island, Warwickshire to Minworth Island, Birmingham so that it is no longer a trunk road, but becomes a principal road.
