Civil Contingencies

The Civil Contingencies Act 2004 (Amendment of List of Responders) Order 2008

The Secretary of State for Health makes the following Order in exercise of the powers conferred by section 13(1) and (3) of the Civil Contingencies Act 2004(1).

A draft of this Order was laid before Parliament in accordance with section 17(2) of the Civil Contingencies Act 2004 and approved by a resolution of each House of Parliament.

Citation and commencement

1.  This Order may be cited as the Civil Contingencies Act 2004 (Amendment of List of Responders) Order 2008 and shall come into force on 1st April 2009.

Amendment of Schedule 1 to the Civil Contingencies Act 2004

2.  In Part 1 of Schedule 1 to the Civil Contingencies Act 2004 (Category 1 responders: general), for paragraph 6 substitute—

6.  An NHS foundation trust within the meaning of section 30 of the National Health Service Act 2006(2) if, and in so far as, it has the function of providing—

(a)ambulance services, or

(b)hospital accommodation and services in relation to accidents and emergencies..

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends Part 1 of Schedule 1 to the Civil Contingencies Act 2004 (which lists Category 1 responders for the purposes of Part 1 of that Act). The Order provides that NHS foundation trusts are Category 1 responders, if and insofar as they have the function of providing ambulance services, or hospital accommodation and services in relation to accidents and emergencies.

An impact assessment has not been produced for this instrument as it has no impact on the private and voluntary sectors.
