The Erskine Bridge Tolls Order 1992

The Secretary of State, in exercise of the powers conferred on him by sections 2 and 15(1) of the Erskine Bridge Tolls Act 1968(1) and of all other powers enabling him in that behalf, and having complied with the provisions of section 3 of the said Act, hereby makes the following Order:

Citation and commencement

1.  This Order may be cited as the Erskine Bridge Tolls Order 1992 and shall come into force on 1st April 1992.

Interpretation

2.  In this Order, unless the context otherwise requires, the following expressions have the following meanings:—

“the Act” means the Erskine Bridge Tolls Act 1968;

“the 1989 Order” means the Erskine Bridge Tolls Order 1989(2);

“the specified roads” has the meaning given in section 1(3) of the Act;

“Class I”, “Class II” and “Class IV” have the meanings respectively given in Schedule 3 to the Roads (Scotland) Act 1984(3).

Vehicles in respect of which tolls are to be levied

3.  Subject to article 6 of this Order, every vehicle of Class I, Class II or Class IV using any part of the specified roads shall be a vehicle in respect of which a toll is to be levied under the Act.

Amount of toll

4.  Subject to article 5 hereof, the toll to be levied for each occasion on which any vehicle described in article 3 hereof uses any part of the specified roads shall be 60p.

Compounding in advance for payment of tolls

5.—(1) Any person may compound in advance for the payment of tolls levied under the Act by purchasing a minimum of 50 (or multiples thereof) prepaid vouchers at the rate specified in article 5(2) hereof.

(2) Each prepaid voucher shall be in respect of one occasion that a toll is leviable in terms of article 4 hereof and shall cost 10% less than that toll.

Vehicles exempt from payment of tolls

6.  Any vehicle of any of the descriptions specified in the Schedule to this Order, which would otherwise be a vehicle in respect of which a toll is to be levied as set out in article 3 above, shall be exempted from the payment of toll.

Revocation

7.  The 1989 Order is hereby revoked.

Article 6

SCHEDULE DESCRIPTIONS OF VEHICLES EXEMPTED FROM PAYMENT OF TOLLS

1.  Any vehicle belonging to a fire authority and being used in the discharge of the functions of such authority under the Fire Service Acts 1947 to 1959(4).

2.  Any vehicle belonging to, and being used for the purposes of, a police authority, and any other vehicle being used by a police officer acting in the execution of his duty.

3.  Any ambulance or other means of transport provided under section 45 of the National Health Service (Scotland) Act 1978(5).

4.  Those vehicles, not at any one time exceeding five in number, belonging to the Princess Louise Scottish Hospital for Limbless Sailors and Soldiers, Erskine in respect of which the Secretary of State has issued a written authorisation exempting them from payment.

5.  Any vehicle being used in connection with the levying of tolls, or with the inspection, maintenance, repair, renewal, or improvement of, or the provision of additions to, the specified roads (including any part of them and any structure, works or apparatus in, on, under or over them).

6.  Any northbound vehicle which, as a direct result of having broken down on the specified roads, thereupon re-enters those roads travelling southwards but not under its own power.

7.  Any vehicle fitted with controls enabling it to be driven by a person having a particular disability and which, in accordance with section 7(2) of the Vehicles (Excise) Act 1971(6), is not charged with any duty under that Act.

8.  Any vehicle displaying a badge issued by a local authority in exercise of its powers under section 21 of the Chronically Sick and Disabled Persons Act 1970(7) and conveying, either as driver or passenger, the disabled person in respect of whom such badge was issued.

9.  Any motor bicycle or motor scooter with or without sidecar, and any power assisted bicycle or tricycle.

Explanatory Note

(This note is not part of the Order)

This Order prescribes the toll to be levied for vehicles using the bridge across the River Clyde at Erskine, exempts certain vehicles from payment of the toll, and permits any person to pay the toll in advance by the purchase of prepaid vouchers in multiples of 50 at a 10% discount. Offences relating to the non-payment of tolls which are due and to fraud connected with the payment of tolls are set out in section 11(a) and (b) of the Erskine Bridge Tolls Act 1968.
