The Food (Forces Exemptions) (Revocations) Regulations 1992

The Minister of Agriculture, Fisheries and Food, the Secretary of State for Health, and the Secretary of State for Wales, acting jointly in relation to England and Wales, and the Secretary of State for Scotland in relation to Scotland, in exercise of the powers conferred on them by sections 4(1), 16(1) and (3) and 48(1) of, and paragraph 1 of Schedule 1 to, the Food Safety Act 1990(1), and of all other powers enabling them in that behalf; the Minister of Agriculture, Fisheries and Food and the Secretary of State, being Ministers designated(2) for the purposes of section 2(2) of the European Communities Act 1972(3) in relation to the common agricultural policy of the European Economic Community, acting jointly, in exercise of the powers conferred on them by the said section 2(2); after consultation in accordance with section 48(4) of the Food Safety Act 1990 with such organisations as appear to them to be representative of interests likely to be substantially affected by the Regulations (in so far as the Regulations are made in exercise of the powers conferred by that Act); hereby make the following Regulations:—

Title and commencement

1.  These Regulations may be cited as the Food (Forces Exemptions) (Revocations) Regulations 1992 and shall come into force on 16th November 1992.

Revocations of forces exemptions

2.—(1) Subject to paragraph (2) below, the Regulations specified in columns 1 and 2 of the Schedule to these Regulations are hereby amended by revoking the provisions of each of those Regulations specified in column 3 of that Schedule.

(2) The revocations made by paragraph (1) above shall not have effect in relation to any food prepared and labelled for sale before 16th November 1992.

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend Regulations having effect under the Food Safety Act 1990, the Natural Mineral Waters Regulations 1985 made under the European Communities Act 1972 and the Food Labelling Regulations 1984 and the Food Labelling (Scotland) Regulations 1984 which have effect under both those Acts. Regulation 2(1) removes from the Regulations listed in the Schedule the specified provisions in those Regulations which exempt from their application supplies of food under Government contracts to Her Majesty’s forces or food supplied for consumption by a visiting force, within the meaning of the Visiting Forces Act 1952 (c. 67, as amended by the Criminal Justice Act 1988, c. 33, section 170 and paragraph 14 of Schedule 15). Those Regulations will now apply to such supplies of food.

Regulation 2(2) is a transitional provision for food within the scope of the exemptions removed by regulation 2(1) which has been prepared and labelled for sale before 16th November 1992, the date on which these Regulations come into force.
