36In the application of section 46 of the Act of 1962 to an enforcement notice by virtue of paragraph 33 or 34 of this Schedule, subsection (1) of that section shall have effect as if for paragraphs (b) and (c) there were substituted the following paragraph—
“(b)that the works or use to which the enforcement notice relates are not works or a use to which section 75 of the Act of 1947 applies "”
