The Secretary of State, in exercise of powers conferred by paragraph 16(1)(a) of Schedule 4 to the Protection of Freedoms Act 2012(1) makes the following Order.
A draft of this instrument was laid before Parliament in accordance with paragraph 17(2) of Schedule 4 to the Protection of Freedoms Act 2012 and approved by a resolution of each House of Parliament.
1.—(1) This Order may be cited as the Protection of Freedoms Act 2012 (Definition of Relevant Land) (Amendment) Order 2025 and comes into force 29 days after the day on which it is made.
(2) This Order extends to England and Wales.
2. At the end of paragraph 3(4) of Schedule 4 to the Protection of Freedoms Act 2012 insert “, but not byelaws made under section 219 of the Transport Act 2000(2) by the Strategic Rail Authority, confirmed under Schedule 20 of the Transport Act 2000 and preserved by section 46(4) of the Railways Act 2005(3)”.

This Order amends the Protection of Freedoms Act 2012 to bring land subject to the Railway Byelaws within the definition of relevant land in Schedule 4 to that Act in order to facilitate the recovery of unpaid car parking charges from the keeper or hirer of a vehicle parked in a station car park.
A full impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sectors is foreseen.

2000 c. 38. Section 219 of, and Schedule 20 to, the Transport Act 2000 were repealed by paragraph 36(c) of Schedule 1 and Part 1 of Schedule 13 to the Railways Act 2005.
