The Scottish Ministers make the following Order in exercise of the powers conferred by section 216(2) of the Education Reform Act 1988(1), and all other powers enabling them to do so.
Citation, commencement and extent
1.—(1) This Order may be cited as the Education (Listed Bodies) (Scotland) Amendment Order 2022 and comes into force on 5 December 2022.
(2) This Order extends to Scotland only.
Amendment of the Education (Listed Bodies) (Scotland) Order 2018
2. The Education (Listed Bodies) (Scotland) Order 2018(2) is amended in accordance with article 3.
3. In section 1 of Part 1 of the schedule (bodies providing courses in preparation for a degree generally)—
(a)for “Mary Hare Grammer School” substitute “Mary Hare”, and
(b)for “St Philips’s Centre” substitute “St Philip’s Centre Ltd”.

EXPLANATORY NOTE
(This note is not part of the Order)
The Education (Listed Bodies) (Scotland) Order 2018 (“the 2018 Order”) lists the name of every body which is not a recognised body within section 216(4)(a) or (b) of the Education Reform Act 1988 but which appears to the Scottish Ministers either-
a)
to provide a course which is in preparation for a degree to be granted by such a recognised body and is approved by or on behalf of the recognised body, or
b)
to be a constituent college, school, hall or other institution of a university which is such a recognised body.
This Order amends the 2018 Order to correct minor drafting errors in the list of bodies contained in section 1 of Part 1 of the schedule of that Order, which sets out the list of bodies that appear to the Scottish Ministers to provide courses in preparation for a degree generally.

1988 c. 40. Relevant amendments to that Act were made by the Higher Education and Research Act 2017 c. 29, section 54 and relevant modifications were made by S.I. 1999/1820. The functions of the Secretary of State were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c. 46).

Policy Note

They aim to make the Scottish Statutory Instrument accessible to readers who are not legally qualified and accompany any Scottish Statutory Instrument or Draft Scottish Statutory Instrument laid before the Scottish Parliament from July 2012 onwards. Prior to this date these type of notes existed as ‘Executive Notes’ and accompanied Scottish Statutory Instruments from July 2005 until July 2012.
