The Counsellors of State in Council

Whereas Her Majesty in pursuance of the Regency Acts 1937 to 1953, was pleased, by Letters Patent dated the 28th day of March 1988, to delegate to the six Counsellors of State therein named or any two or more of them full power and authority during the period of Her Majesty’s absence from the United Kingdom to summon and hold on Her Majesty’s behalf Her Privy Council and to signify thereat Her Majesty’s approval for anything for which Her Majesty’s approval in Council is required:

And Whereas a draft of this Order has been approved by a resolution of each House of Parliament:

Now, therefore, Her Majesty Queen Elizabeth, The Queen Mother and His Royal Highness The Price Charles, Prince of Wales, being authorised thereto by the the said Letters Patent, and in pursuance of the powers conferred by paragraph 1 of Schedule 1 to the Northern Ireland Act 1974(1), and all other powers enabling Her Majesty, and by and with the advice of Her Majesty’s Privy Council, do on Her Majesty’s behalf order, and it is hereby ordered, as follows:—

Title and commencement

1.  This Order may be cited as the General Assistance Grants (Abolition) (Northern Ireland) Order 1988 and shall come into operation forthwith.

Interpretation

2.—(1) The Interpretation Act (Northern Ireland) 1954(2) shall apply to Article 1 and the following provisions of this Order as it applies to a Measure of the Northern Ireland Assembly.

(2) In this Order—

“the Department” means the Department of Economic Development;

“the 1982 Order” means the Industrial Development (Northern Ireland) Order 1982(3).

(3) Article 25 of the 1982 Order in so far as it relates to the definition or interpretation of words or expressions used in Part IV of that Order and in this Order shall, notwithstanding its repeal by this Order, apply for the purposes of this Order as it applies for the purposes of Part IV of that Order.

Abolition of general assistance grants

3.  The Department shall not pay any grant under Part IV of the 1982 Order towards capital expenditure incurred on or after 1st April 1988.

Repeals and transitional provisions

4.—(1) Subject to paragraph (2), the following provisions of the 1982 Order are hereby repealed, namely—

(a)Part IV;

(b)Article 34(4).

(2) Paragraph (1) does not affect the operation of Part IV and Article 34(4) of the 1982 Order in relation to any grant paid or payable under that Part towards approved capital expenditure incurred before 1st April 1988.

(3) Without prejudice to the operation of any order made under Article 22(2)(c) of the 1982 Order, the Department shall not pay any grant under Part IV of that Order if the application for that grant is made after 31st March 1990.
