recognising the Government of Nunavut as a body that is authorised to issue documents attesting compliance with Regulation (EC) No 1007/2009 of the European Parliament and of the Council for placing seal products on the Union market

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EC) No 1007/2009 of the European Parliament and of the Council of 16 September 2009 on trade in seal products(1) and, in particular, the second subparagraph of Article 3(1a) thereof,

Whereas:

(1) Regulation (EC) No 1007/2009 establishes harmonised rules concerning the placing on the Union market of seal products. It lays down in its Article 3(1) the conditions for placing on the market of seal products resulting from hunts conducted by Inuit or other indigenous communities. At the time of placing seal products on the market, they are to be accompanied by a document attesting compliance with the conditions set out in Article 3(1) of Regulation (EC) No 1007/2009 issued by a body recognised for that purpose by the Commission.

(2) By Decision C(2015) 5253(2), the Commission recognised the ‘Department of Environment, Government of Nunavut’ as a body authorised to issue documents attesting compliance with the conditions set out in Article 3(1) of Regulation (EC) No 1007/2009 for placing seal products on the Union market.

(3) In light of the amendments to Regulation (EC) No 1007/2009 by Regulation (EU) 2015/1775 of the European Parliament and of the Council(3) and of Commission Implementing Regulation (EU) 2015/1850(4), the Commission adopted Decision C(2015) 7273(5) in addition to Decision C(2015) 5253.

(4) On 4 August 2020, the Commission received a letter from the Department of Economic Development and Transportation of Nunavut dated 22 April 2020 requesting to amend the name of its recognised body to reflect a reorganisation inside the Government of Nunavut.

(5) The Department of Economic Development and Transportation of Government of Nunavut asked for the name ‘Department of Environment, Government of Nunavut’ to be changed to ‘Government of Nunavut’.

(6) The Department of Economic Development and Transportation of Government of Nunavut specified that this change of name did not imply any change in the function and role of the recognised body.

(7) The body ‘Government of Nunavut’ satisfies the requirements for recognised bodies set out in the third subparagraph of Article 3(1a) of Regulation (EC) No 1007/2009 and Article 3(1) of Implementing Regulation (EU) 2015/1850.

(8) It is therefore appropriate to recognise the body ‘Government of Nunavut’ as a body that is authorised to issue documents attesting compliance with the conditions set out in Article 3(1) of Regulation (EC) No 1007/2009,

HAS ADOPTED THIS DECISION:

Article 1U.K.

The body ‘Government of Nunavut’ is hereby recognised as a body that is authorised to issue documents attesting compliance with the conditions set out in Article 3(1) of Regulation (EC) No 1007/2009.

Article 2U.K.

Decisions C(2015) 5253 and C(2015) 7273 are repealed.

Article 3U.K.

This Decision shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
