<Title>Pupil’s involvement in decision about withdrawal from religious observance</Title>

<P1para>

<Pnumber>1</Pnumber>
<P2para>
<Text>This section applies if a parent has made a request to withdraw a pupil from religious observance in a school under section 9(1).</Text>
</P2para>
</P2>
<P2>
<Pnumber>2</Pnumber>
<P2para>
<Text>The operator of the school must—</Text>
<P3>
<Pnumber>a</Pnumber>
<P3para>
<Text>provide the parent with written information setting out the process for considering a request for withdrawal,</Text>
</P3para>
</P3>
<P3>
<Pnumber>b</Pnumber>
<P3para>
<Text>tell the pupil about the request and the pupil’s right to object to withdrawal,</Text>
</P3para>
</P3>
<P3>
<Pnumber>c</Pnumber>
<P3para>
<Text>give the pupil an opportunity to express the pupil’s views about the request in—</Text>
<P4>
<Pnumber>i</Pnumber>
<P4para>
<Text>the manner that the pupil prefers, or</Text>
</P4para>
</P4>
<P4>
<Pnumber>ii</Pnumber>
<P4para>
<Text>a manner that is suitable to the pupil if the pupil has not indicated a preference or it is not reasonable to accommodate the pupil’s preference, and</Text>
</P4para>
</P4>
</P3para>
</P3>
<P3>
<Pnumber>d</Pnumber>
<P3para>
<Text>have regard to any views expressed by the pupil about the request, taking into account the pupil’s age and maturity.</Text>
</P3para>
</P3>
</P2para>
</P2>
<P2>
<Pnumber>3</Pnumber>
<P2para>
<Text>The operator is not required to comply with subsection (2) if satisfied that the pupil is not capable of forming a view.</Text>
</P2para>
</P2>
<P2>
<Pnumber>4</Pnumber>
<P2para>
<Text>The pupil is to be presumed to be capable of forming a view unless the contrary is shown.</Text>
</P2para>
</P2>
<P2>
<Pnumber>5</Pnumber>
<P2para>
<Text>If, after the operator has complied with subsection (2), the pupil objects to the parent’s request, the operator must—</Text>
<P3>
<Pnumber>a</Pnumber>
<P3para>
<Text>seek to discuss the pupil’s objection with the pupil and the parent, and</Text>
</P3para>
</P3>
<P3>
<Pnumber>b</Pnumber>
<P3para>
<Text>have regard to any views expressed during any discussion.</Text>
</P3para>
</P3>
</P2para>
</P2>
<P2>
<Pnumber>6</Pnumber>
<P2para>
<Text>If the pupil objects to the parent’s request, after the operator has complied with subsection (5) the operator is not to give effect to the parent’s request.</Text>

<Pnumber>7</Pnumber>
<P2para>
<Text>In carrying out its functions under this section, an operator must—</Text>
<P3>
<Pnumber>a</Pnumber>
<P3para>
<Text>act impartially, and</Text>
</P3para>
</P3>
<P3>
<Pnumber>b</Pnumber>
<P3para>
<Text>not seek to influence the views of the pupil in relation to a request for withdrawal.</Text>
</P3para>
</P3>

<Pnumber>8</Pnumber>

<Text>In this section and section 9B, “<Term>operator</Term>” means—</Text>
<P3>
<Pnumber>a</Pnumber>
<P3para>
<Text>where the school is a public school, the education authority by which it is managed,</Text>

<Pnumber>b</Pnumber>
<P3para>
<Text>where the school is a grant-aided school, the managers.</Text>

<Title>Guidance to operators on section 9A</Title>

<Text>The Scottish Ministers must issue guidance to operators about the carrying out of functions under section 9A.</Text>
</P2para>
</P2>
<P2>
<Pnumber>2</Pnumber>
<P2para>
<Text>The guidance must, in particular, include information about—</Text>
<P3>
<Pnumber>a</Pnumber>
<P3para>
<Text>the process for considering a request for withdrawal from religious observance,</Text>
</P3para>
</P3>
<P3>
<Pnumber>b</Pnumber>
<P3para>
<Text>support available to pupils and parents about the process,</Text>
</P3para>
</P3>
<P3>
<Pnumber>c</Pnumber>
<P3para>
<Text>assessing whether a pupil is capable of forming a view about a request,</Text>
</P3para>
</P3>
<P3>
<Pnumber>d</Pnumber>
<P3para>
<Text>handling of discussion between pupils and parents about a request.</Text>
</P3para>
</P3>
</P2para>
</P2>
<P2>
<Pnumber>3</Pnumber>
<P2para>
<Text>Before issuing guidance under subsection (1), the Scottish Ministers must consult—</Text>
<P3>
<Pnumber>a</Pnumber>
<P3para>
<Text>operators of schools,</Text>
</P3para>
</P3>
<P3>
<Pnumber>b</Pnumber>
<P3para>
<Text>persons appearing to the Scottish Ministers to represent the interests of—</Text>

<Pnumber>i</Pnumber>
<P4para>
<Text>teachers,</Text>
</P4para>
</P4>
<P4>
<Pnumber>ii</Pnumber>
<P4para>
<Text>parents,</Text>
</P4para>
</P4>
<P4>

<Text>children and young people,</Text>

<Text>The Scottish Ministers may by regulations provide for pupils to have a right to request withdrawal from any religious observance in a public or grant-aided school.</Text>

<Text>Before making regulations under subsection (1), the Scottish Ministers must consult such persons as they consider appropriate.</Text>

</P2>

<Title>Guidance on meaning of religious observance</Title>
<P1>
<Pnumber>9D</Pnumber>
<P1para>
<P2>
<Pnumber>1</Pnumber>
<P2para>
<Text>The Scottish Ministers must issue guidance to operators about the meaning of religious observance for the purposes of sections 8, 9 and 9A.</Text>

<P2para>
<Text>In preparing guidance under subsection (1), the Scottish Ministers must have regard to the importance of inclusiveness in the content and delivery of religious observance in schools.</Text>

</P2>

<Pnumber>3</Pnumber>
<P2para>
<Text>Before issuing guidance under subsection (1), the Scottish Ministers must consult—</Text>
<P3>
<Pnumber>a</Pnumber>
<P3para>
<Text>operators of schools,</Text>
</P3para>
</P3>
<P3>
<Pnumber>b</Pnumber>
<P3para>
<Text>persons appearing to the Scottish Ministers to represent the interests of—</Text>

<Text>The Scottish Ministers must, as soon as reasonably practicable after the end of each school year, prepare and publish a report setting out the number of pupils who have been withdrawn from religious observance in schools during that school year.</Text>

<Text>In this section, “<Term>school year</Term>” means the period of 12 months beginning on 1 August.</Text>
