eId="part-1"><num>Part 1</num><heading>Withdrawal of pupils from religious instruction or religious observance in schools</heading><section eId="section-1"><num>1</num><heading>Withdrawal of pupils from religious instruction or religious observance in schools</heading><subsection eId="section-1-1"><num>(1)</num><content><p>The Education (Scotland) Act 1980 is modified as follows.</p></content></subsection><subsection eId="section-1-2"><num>(2)</num><content><p><mod>In section 8 (religious instruction), after subsection (1) insert—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="asp" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><subsection><num>(1A)</num><content><p>With effect from the day on which section 1(2) of the Children (Withdrawal from Religious Education and Amendment of UNCRC Compatibility Duty) (Scotland) Act 2026 comes into force, the continuation of the custom described in subsection (1) is to be read so as not to include any right for parents to elect that their children should not receive instruction in religion.</p></content></subsection></quotedStructure><inline name="appendText">.</inline></mod></p></content></subsection><subsection eId="section-1-3"><num>(3)</num><intro><p>In section 9 (conscience clause)—</p></intro><level class="para1" eId="section-1-3-a"><num>(a)</num><content><p>the words “from any instruction in religious subjects and” are repealed,</p></content></level><level class="para1" eId="section-1-3-b"><num>(b)</num><content><p><mod>for the words “his being withdrawn from any instruction in religious subjects” substitute <quotedText>“withdrawal from any such religious observance”</quotedText>,</mod></p></content></level><level class="para1" eId="section-1-3-c"><num>(c)</num><content><p>the existing text becomes subsection (1),</p></content></level><level class="para1" eId="section-1-3-d"><num>(d)</num><content><p><mod>after that subsection insert—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="asp" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><subsection><num>(2)</num><content><p>The exercise of the right under subsection (1) for a parent to withdraw a pupil from religious observance in a school is subject to section 9A.</p></content></subsection><subsection><num>(3)</num><content><p>Where a pupil is withdrawn from religious observance, the education authority or, in the case of a grant-aided school, the managers, must ensure that the pupil is provided with suitable and purposeful educational activity during that period.</p></content></subsection></quotedStructure><inline name="appendText">.</inline></mod></p></content></level></subsection><subsection eId="section-1-4"><num>(4)</num><content><p><mod>After section 9 insert—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="asp" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><section><num>9A</num><heading>Pupil’s involvement in decision about withdrawal from religious observance</heading><subsection><num>(1)</num><content><p>This section applies if a parent has made a request to withdraw a pupil from religious observance in a school under section 9(1).</p></content></subsection><subsection><num>(2)</num><intro><p>The operator of the school must—</p></intro><level class="para1"><num>(a)</num><content><p>provide the parent with written information setting out the process for considering a request for withdrawal,</p></content></level><level class="para1"><num>(b)</num><content><p>tell the pupil about the request and the pupil’s right to object to withdrawal,</p></content></level><level class="para1"><num>(c)</num><intro><p>give the pupil an opportunity to express the pupil’s views about the request in—</p></intro><level class="para2"><num>(i)</num><content><p>the manner that the pupil prefers, or</p></content></level><level class="para2"><num>(ii)</num><content><p>a manner that is suitable to the pupil if the pupil has not indicated a preference or it is not reasonable to accommodate the pupil’s preference, and</p></content></level></level><level class="para1"><num>(d)</num><content><p>have regard to any views expressed by the pupil about the request, taking into account the pupil’s age and maturity.</p></content></level></subsection><subsection><num>(3)</num><content><p>The operator is not required to comply with subsection (2) if satisfied that the pupil is not capable of forming a view.</p></content></subsection><subsection><num>(4)</num><content><p>The pupil is to be presumed to be capable of forming a view unless the contrary is shown.</p></content></subsection><subsection><num>(5)</num><intro><p>If, after the operator has complied with subsection (2), the pupil objects to the parent’s request, the operator must—</p></intro><level class="para1"><num>(a)</num><content><p>seek to discuss the pupil’s objection with the pupil and the parent, and</p></content></level><level class="para1"><num>(b)</num><content><p>have regard to any views expressed during any discussion.</p></content></level></subsection><subsection><num>(6)</num><content><p>If the pupil objects to the parent’s request, after the operator has complied with subsection (5) the operator is not to give effect to the parent’s request.</p></content></subsection><subsection><num>(7)</num><intro><p>In carrying out its functions under this section, an operator must—</p></intro><level class="para1"><num>(a)</num><content><p>act impartially, and</p></content></level><level class="para1"><num>(b)</num><content><p>not seek to influence the views of the pupil in relation to a request for withdrawal.</p></content></level></subsection><subsection><num>(8)</num><intro><p>In this section and section 9B, “<term refersTo="#term-operator">operator</term>” means—</p></intro><level class="para1"><num>(a)</num><content><p>where the school is a public school, the education authority by which it is managed,</p></content></level><level class="para1"><num>(b)</num><content><p>where the school is a grant-aided school, the managers.</p></content></level></subsection></section><section><num>9B</num><heading>Guidance to operators on section 9A</heading><subsection><num>(1)</num><content><p>The Scottish Ministers must issue guidance to operators about the carrying out of functions under section 9A.</p></content></subsection><subsection><num>(2)</num><intro><p>The guidance must, in particular, include information about—</p></intro><level class="para1"><num>(a)</num><content><p>the process for considering a request for withdrawal from religious observance,</p></content></level><level class="para1"><num>(b)</num><content><p>support available to pupils and parents about the process,</p></content></level><level class="para1"><num>(c)</num><content><p>assessing whether a pupil is capable of forming a view about a request,</p></content></level><level class="para1"><num>(d)</num><content><p>handling of discussion between pupils and parents about a request.</p></content></level></subsection><subsection><num>(3)</num><intro><p>Before issuing guidance under subsection (1), the Scottish Ministers must consult—</p></intro><level class="para1"><num>(a)</num><content><p>operators of schools,</p></content></level><level class="para1"><num>(b)</num><intro><p>persons appearing to the Scottish Ministers to represent the interests of—</p></intro><level class="para2"><num>(i)</num><content><p>teachers,</p></content></level><level class="para2"><num>(ii)</num><content><p>parents,</p></content></level><level class="para2"><num>(iii)</num><content><p>children and young people,</p></content></level><level class="para2"><num>(iv)</num><content><p>denominational schools.</p></content></level></level></subsection><subsection><num>(4)</num><content><p>An operator must, in carrying out functions under section 9A, have regard to guidance issued under subsection (1).</p></content></subsection><subsection><num>(5)</num><intro><p>The Scottish Ministers must publish guidance issued under subsection (1)—</p></intro><level class="para1"><num>(a)</num><content><p>within the period of 12 months beginning with the day on which this section comes into force,</p></content></level><level class="para1"><num>(b)</num><content><p>in such manner as they consider appropriate.</p></content></level></subsection></section><section><num>9C</num><heading>Power to introduce independent right of withdrawal from religious observance</heading><subsection><num>(1)</num><content><p>The Scottish Ministers may by regulations provide for pupils to have a right to request withdrawal from any religious observance in a public or grant-aided school.</p></content></subsection><subsection><num>(2)</num><content><p>Before making regulations under subsection (1), the Scottish Ministers must consult such persons as they consider appropriate.</p></content></subsection></section><section><num>9D</num><heading>Guidance on meaning of religious observance</heading><subsection><num>(1)</num><content><p>The Scottish Ministers must issue guidance to operators about the meaning of religious observance for the purposes of sections 8, 9 and 9A.</p></content></subsection><subsection><num>(2)</num><content><p>In preparing guidance under subsection (1), the Scottish Ministers must have regard to the importance of inclusiveness in the content and delivery of religious observance in schools.</p></content></subsection><subsection><num>(3)</num><intro><p>Before issuing guidance under subsection (1), the Scottish Ministers must consult—</p></intro><level class="para1"><num>(a)</num><content><p>operators of schools,</p></content></level><level class="para1"><num>(b)</num><intro><p>persons appearing to the Scottish Ministers to represent the interests of—</p></intro><level class="para2"><num>(i)</num><content><p>teachers,</p></content></level><level class="para2"><num>(ii)</num><content><p>parents,</p></content></level><level class="para2"><num>(iii)</num><content><p>children and young people,</p></content></level><level class="para2"><num>(iv)</num><content><p>denominational schools.</p></content></level></level></subsection><subsection><num>(4)</num><content><p>An operator must, in carrying out functions under sections 8, 9 and 9A, have regard to guidance issued under subsection (1).</p></content></subsection><subsection><num>(5)</num><intro><p>The Scottish Ministers must publish guidance issued under subsection (1)—</p></intro><level class="para1"><num>(a)</num><content><p>within the period of 12 months beginning with the day on which this section comes into force,</p></content></level><level class="para1"><num>(b)</num><content><p>in such manner as they consider appropriate.</p></content></level></subsection></section><section><num>9E</num><heading>Reporting on withdrawal from religious observance</heading><subsection><num>(1)</num><content><p>The Scottish Ministers must, as soon as reasonably practicable after the end of each school year, prepare and publish a report setting out the number of pupils who have been withdrawn from religious observance in schools during that school year.</p></content></subsection><subsection><num>(2)</num><content><p>In this section, “<term refersTo="#term-school-year">school year</term>” means the period of 12 months beginning on 1 August.</p></content></subsection></section></quotedStructure><inline name="appendText">.</inline></mod></p></content></subsection><subsection eId="section-1-5"><num>(5)</num><content><p><mod>In section 133 (regulations, etc.), after subsection (2XA) insert—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="asp" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><subsection><num>(2XAA)</num><content><p>Subsection (2) does not apply to any regulations under section 9C; and such regulations are subject to the affirmative procedure.</p></content></subsection></quotedStructure><inline name="appendText">.</inline></mod></p></content></subsection></section><section eId="section-2"><num>2</num><heading>Review of modifications made by section 1</heading><subsection eId="section-2-1"><num>(1)</num><intro><p>The Scottish Ministers must—</p></intro><level class="para1" eId="section-2-1-a"><num>(a)</num><content><p>undertake a review of the operation of the provisions of the Education (Scotland) Act 1980 which are modified by section 1, and</p></content></level><level class="para1" eId="section-2-1-b"><num>(b)</num><content><p>prepare and publish a report on that review.</p></content></level></subsection><subsection eId="section-2-2"><num>(2)</num><content><p>The report prepared under subsection (1)(b) must be published no later than the end of the period of 3 years beginning with the day on which section 1(4) comes into force.</p></content></subsection><subsection eId="section-2-3"><num>(3)</num><intro><p>The report must, in particular, contain—</p></intro><level class="para1" eId="section-2-3-a"><num>(a)</num><content><p>information about how religious observance has been delivered in schools during the period covered by the review,</p></content></level><level class="para1" eId="section-2-3-b"><num>(b)</num><content><p>an assessment of the inclusiveness of the content and delivery of religious observance during that period.</p></content></level></subsection><subsection eId="section-2-4"><num>(4)</num><intro><p>The report must include—</p></intro><level class="para1" eId="section-2-4-a"><num>(a)</num><content><p>a statement of any actions the Scottish Ministers intend to take following the report (including, in particular, actions to enable children to withdraw from religious observance), or</p></content></level><level class="para1" eId="section-2-4-b"><num>(b)</num><content><p>where the Scottish Ministers do not intend to take any actions, their reasons for not taking actions.</p></content></level></subsection><subsection eId="section-2-5"><num>(5)</num><content><p>The Scottish Ministers must lay a copy of the report before the Scottish Parliament.</p></content></subsection></section></part><part eId="part-2"><num>Part 2</num><heading>United Nations Convention on the Rights of the Child (Incorporation) (Scotland) Act 2024: circumstances where incompatible action or failure to act is not unlawful</heading><section eId="section-3"><num>3</num><heading>United Nations Convention on the Rights of the Child (Incorporation) (Scotland) Act 2024: circumstances where incompatible action or failure to act is not unlawful</heading><subsection eId="section-3-1"><num>(1)</num><content><p>The United Nations Convention on the Rights of the Child (Incorporation) (Scotland) Act 2024 is modified as follows.</p></content></subsection><subsection eId="section-3-2"><num>(2)</num><intro><p>In section 6 (acts of public authorities to be compatible with the UNCRC requirements)—</p></intro><level class="para1" eId="section-3-2-a"><num>(a)</num><content><p><mod>in subsection (1), for “subsection (4)” insert <quotedText>“sections 6A and 6B”</quotedText>,</mod></p></content></level><level class="para1" eId="section-3-2-b"><num>(b)</num><content><p>subsection (4) is repealed.</p></content></level></subsection><subsection eId="section-3-3"><num>(3)</num><content><p><mod>After section 6 insert—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="asp" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><section><num>6A</num><heading>No unlawfulness where incompatible action or failure to act relies on UK enactment</heading><intro><p>Section 6(1) does not make unlawful doing or failing to do something if the public authority was required or entitled to act in that way by words that—</p></intro><level class="para1"><num>(a)</num><content><p>are not contained in an enactment of a kind mentioned in section 6(2)(b), or</p></content></level><level class="para1"><num>(b)</num><content><p>are contained in such an enactment having been inserted into it by an enactment of a kind that is not mentioned in section 6(2)(b).</p></content></level></section><section><num>6B</num><heading>No unlawfulness where incompatible action or failure to act relies on Scottish enactment</heading><subsection><num>(1)</num><content><p>Section 6(1) does not make unlawful doing or failing to do something if the public authority was required to act in that way by words in an Act of the Scottish Parliament to which section 29 applies.</p></content></subsection><subsection><num>(2)</num><intro><p>Section 6(1) does not make unlawful doing or failing to do something if—</p></intro><level class="para1"><num>(a)</num><content><p>the public authority was required to act in that way by words in a Scottish Rights (unless the person to whom the intimation would be given is a party to the proceedings).</p></content></subsection><subsection><num>(2)</num><content><p>A person to whom intimation is given under subsection (1) may, on giving notice, take part as a party in the proceedings so far as the proceedings relate to that question.</p></content></subsection></section></quotedStructure><inline eId="section-4"><num>4</num><heading>Ancillary provision</heading><subsection eId="section-4-1"><num>(1)</num><content><p>The Scottish Ministers may by regulations make any incidental, supplementary, consequential, transitional, transitory or saving provision they consider appropriate for the purposes of, in connection with, or for giving full effect to this Act.</p></content></subsection><subsection eId="section-4-2"><num>(2)</num><intro><p>Regulations under this section may—</p></intro><level class="para1" eId="section-4-2-a"><num>(a)</num><content><p>modify any enactment (including this Act),</p></content></level><level class="para1" eId="section-4-2-b"><num>(b)</num><content><p>make different provision for different purposes.</p></content></level></subsection><subsection eId="section-4-3"><num>(3)</num><intro><p>Regulations under this section—</p></intro><level class="para1" eId="section-4-3-a"><num>(a)</num><content><p>which add to, replace or omit any part of the text of an Act are subject to the affirmative procedure, but</p></content></level><level class="para1" eId="section-4-3-b"><num>(b)</num><content><p>otherwise, are subject to the negative procedure.</p></content></level></subsection></section><section eId="section-5"><num>5</num><heading>Commencement</heading><subsection eId="section-5-1"><num>(1)</num><content><p>This section and sections 4 and 6 come into force on the day after Royal Assent.</p></content></subsection><subsection eId="section-5-2"><num>(2)</num><content><p>Sections 1 and 3 come into force on such day as the Scottish Ministers may by regulations appoint.</p></content></subsection><subsection eId="section-5-3"><num>(3)</num><intro><p>Regulations under subsection (2) may—</p></intro><level class="para1" eId="section-5-3-a"><num>(a)</num><content><p>include transitional, transitory or saving provision,</p></content></level><level class="para1" eId="section-5-3-b"><num>(b)</num><content><p>make
