building action plan</heading><subsection eId="section-5-1"><num>(1)</num><content><p>Each local authority, working jointly with the relevant public bodies relating to it, must prepare a community wealth building action plan for the area of the local authority in question within the period of 3 years beginning with the day on which <ref href="#section-5">this section</ref> comes into force.</p></content></subsection><subsection eId="section-5-2"><num>(2)</num><content><p>Each local authority must publish the community wealth building action plan prepared in accordance with <ref href="#section-5-1">subsection (1)</ref> as soon as reasonably practicable following its preparation.</p></content></subsection><subsection eId="section-5-3"><num>(3)</num><content><p>The Scottish Ministers may by regulations specify further details about the format of the plan to be published under subsection (2) or the revised plan to be published under section 7(3).</p></content></subsection><subsection eId="section-5-4"><num>(4)</num><content><p>Regulations under subsection (3) are subject to the affirmative procedure.</p></content></subsection><subsection eId="section-5-5"><num>(5)</num><intro><p>In relation to the functions conferred on them by this Act—</p></intro><level class="para1" eId="section-5-5-a"><num>(a)</num><content><p>a local authority and the relevant public bodies relating to it are collectively referred to in this Act as a “community wealth building partnership”,</p></content></level><level class="para1" eId="section-5-5-b"><num>(b)</num><content><p>a local authority and each relevant public body relating to it are individually referred to in this Act as a “community wealth building partner”.</p></content></level></subsection><subsection eId="section-5-6"><num>(6)</num><content><p>A community wealth building action plan must set out the measures the community wealth building partnership is taking, or intends to take, to facilitate and support the generation, circulation and retention of wealth in the local economy.</p></content></subsection><subsection eId="section-5-7"><num>(7)</num><intro><p>The measures referred to in <ref href="#section-5-6">subsection (6)</ref> may include—</p></intro><level class="para1" eId="section-5-7-a"><num>(a)</num><content><p>using public procurement and commissioning to facilitate or support such generation, circulation and retention,</p></content></level><level class="para1" eId="section-5-7-b"><num>(b)</num><content><p>supporting local economic operators to access public sector contracts,</p></content></level><level class="para1" eId="section-5-7-c"><num>(c)</num><intro><p>promoting—</p></intro><level class="para2" eId="section-5-7-c-i"><num>(i)</num><content><p>employment opportunity,</p></content></level><level class="para2" eId="section-5-7-c-ii"><num>(ii)</num><content><p>workforce development,</p></content></level><level class="para2" eId="section-5-7-c-iii"><num>(iii)</num><content><p>equality in the workplace,</p></content></level></level><level class="para1" eId="section-5-7-d"><num>(d)</num><content><p>diversifying ownership of land, energy or other assets by facilitating or supporting community ownership,</p></content></level><level class="para1" eId="section-5-7-e"><num>(e)</num><content><p>utilising common good property to provide financial, social or environmental benefit to the community, including the transfer of ownership to community organisations,</p></content></level><level class="para1" eId="section-5-7-f"><num>(f)</num><content><p>bringing vacant and derelict land back into use in a way that provides financial, social or environmental benefit to the community,</p></content></level><level class="para1" eId="section-5-7-g"><num>(g)</num><content><p>encouraging local business start-ups or entrepreneurship,</p></content></level><level class="para1" eId="section-5-7-h"><num>(h)</num><intro><p>promoting or supporting the development of—</p></intro><level class="para2" eId="section-5-7-h-i"><num>(i)</num><content><p>employee-owned businesses,</p></content></level><level class="para2" eId="section-5-7-h-ii"><num>(ii)</num><content><p>co-operatives, including co-operative financial institutions,</p></content></level><level class="para2" eId="section-5-7-h-iii"><num>(iii)</num><content><p>social enterprises,</p></content></level><level class="para2" eId="section-5-7-h-iv"><num>(iv)</num><content><p>supported businesses, as defined by section 11(3) of the Procurement Reform (Scotland) Act 2014,</p></content></level></level><level class="para1" eId="section-5-7-i"><num>(i)</num><content><p>promoting access to investment opportunities that provide a benefit to the community and to local businesses,</p></content></level><level class="para1" eId="section-5-7-j"><num>(j)</num><content><p>measures to support local climate resilience and mitigation of the effects of climate change,</p></content></level><level class="para1" eId="section-5-7-k"><num>(k)</num><content><p>such other measures as the community wealth building partnership considers appropriate.</p></content></level></subsection><subsection eId="section-5-8"><num>(8)</num><content><p>A community wealth building action plan must set an indicative target for the percentage of the total expenditure incurred pursuant to public contracts entered into by the community wealth building partners which is to go to local economic operators.</p></content></subsection><subsection eId="section-5-9"><num>(9)</num><intro><p>A community wealth building action plan—</p></intro><level class="para1" eId="section-5-9-a"><num>(a)</num><content><p>must set out indicators by reference to which the community wealth building partnership intends to assess progress made in relation to the implementation of the measures set out in the action plan,</p></content></level><level class="para1" eId="section-5-9-b"><num>(b)</num><content><p>may set targets in relation to the implementation of the measures set out in the action plan.</p></content></level></subsection><subsection eId="section-5-10"><num>(10)</num><intro><p>The indicators mentioned in subsection (9)(a) may include—</p></intro><level class="para1" eId="section-5-10-a"><num>(a)</num><intro><p>the performance of businesses, including—</p></intro><level class="para2" eId="section-5-10-a-i"><num>(i)</num><content><p>the number of new businesses established,</p></content></level><level class="para2" eId="section-5-10-a-ii"><num>(ii)</num><content><p>the total number of businesses,</p></content></level><level class="para2" eId="section-5-10-a-iii"><num>(iii)</num><content><p>the total business output,</p></content></level></level><level class="para1" eId="section-5-10-b"><num>(b)</num><intro><p>employment outcomes, including—</p></intro><level class="para2" eId="section-5-10-b-i"><num>(i)</num><content><p>average wage,</p></content></level><level class="para2" eId="section-5-10-b-ii"><num>(ii)</num><content><p>availability of skills development programmes,</p></content></level></level><level class="para1" eId="section-5-10-c"><num>(c)</num><intro><p>the diversity of ownership models, including the number of businesses that are—</p></intro><level class="para2" eId="section-5-10-c-i"><num>(i)</num><content><p>employee-owned,</p></content></level><level class="para2" eId="section-5-10-c-ii"><num>(ii)</num><content><p>co-operatives,</p></content></level></level><level class="para1" eId="section-5-10-d"><num>(d)</num><intro><p>the variety of land use, including—</p></intro><level class="para2" eId="section-5-10-d-i"><num>(i)</num><content><p>use of the community right to buy,</p></content></level><level class="para2" eId="section-5-10-d-ii"><num>(ii)</num><content><p>such other use of land as the community wealth building partnership considers relevant,</p></content></level></level><level class="para1" eId="section-5-10-e"><num>(e)</num><content><p>the proportion of pension funds of the community wealth building partners invested locally and regionally,</p></content></level><level class="para1" eId="section-5-10-f"><num>(f)</num><content><p>the growth of local financial institutions, including co-operative financial institutions,</p></content></level><level class="para1" eId="section-5-10-g"><num>(g)</num><content><p>such other indicators as the community wealth building partnership considers appropriate.</p></content></level></subsection><subsection eId="section-5-11"><num>(11)</num><content><p>In preparing a community wealth building action plan, a community wealth building partnership must consider how the use or disposal of common good land and assets would further the aims of this Act.</p></content></subsection><subsection eId="section-5-12"><num>(12)</num><intro><p>In contributing to the preparation of a community wealth building action plan, a local authority must consult—</p></intro><level class="para1" eId="section-5-12-a"><num>(a)</num><content><p>such persons as it considers likely to be directly affected by the community wealth building action plan,</p></content></level><level class="para1" eId="section-5-12-b"><num>(b)</num><intro><p>such persons as it considers representative of the interests of—</p></intro><level class="para2" eId="section-5-12-b-i"><num>(i)</num><content><p>the community,</p></content></level><level class="para2" eId="section-5-12-b-ii"><num>(ii)</num><content><p>businesses,</p></content></level><level class="para2" eId="section-5-12-b-iii"><num>(iii)</num><content><p>third sector bodies (as defined by section 37(1) of the Community Justice (Scotland) Act 2016),</p></content></level><level class="para2" eId="section-5-12-b-iv"><num>(iv)</num><content><p>social enterprises,</p></content></level><wrapUp><p>within the area of the local authority, and</p></wrapUp></level><level class="para1" eId="section-5-12-c"><num>(c)</num><content><p>such other persons as it considers appropriate.</p></content></level></subsection><subsection eId="section-5-13"><num>(13)</num><intro><p>As soon as reasonably practicable after complying with subsection (2), the local authority must prepare and publish, in such manner as it considers appropriate, a report setting out—</p></intro><level class="para1" eId="section-5-13-a"><num>(a)</num><content><p>the consultation process undertaken in order to comply with subsection (12), and</p></content></level><level class="para1" eId="section-5-13-b"><num>(b)</num><content><p>the ways in which, in contributing to the preparation of the community wealth building action plan, it has taken account of views expressed in the course of that process.</p></content></level></subsection><subsection eId="section-5-14"><num>(14)</num><content><p>In preparing a community wealth building action plan, a community wealth building partnership must have due regard to guidance issued under <ref href="#">section 10</ref><ref href="#">(1)</ref><ref href="#">(a)</ref>.</p></content></subsection><subsection eId="section-5-15"><num>(15)</num><content><p>In this section and in section 8, “<term refersTo="#term-public-contract" eId="term-public-contract">public contract</term>” means a contract for pecuniary interest concluded in writing between one or more economic operators and one or more community wealth building partners and having as its object the execution of works, the supply of products or the provision of services.</p></content></subsection><subsection eId="section-5-16"><num>(16)</num><intro><p>In <ref href="#section-5">this section</ref> and in sections 6 and 10, “<term refersTo="#term-relevant-public-bodies" eId="term-relevant-public-bodies">relevant public bodies</term>” in relation to a local authority are—</p></intro><level class="para1" eId="section-5-16-a"><num>(a)</num><content><p>the board of management of a regional college designated by order under <ref eId="c00001" href="https://www.legislation.gov.uk/asp/2005/6/section/7A">section 7A</ref> of the <ref eId="c00002" href="https://www.legislation.gov.uk/asp/2005/6/contents">Further and Higher Education (Scotland) Act 2005</ref> which is situated wholly or partly in the area of the local authority,</p></content></level><level class="para1" eId="section-5-16-b"><num>(b)</num><content><p>a regional strategic body specified in schedule 2A of the Further and Higher Education (Scotland) Act 2005 which is situated wholly or partly in the area of the local authority,</p></content></level><level class="para1" eId="section-5-16-c"><num>(c)</num><content><p>a Health Board constituted under <ref eId="c00003" href="https://www.legislation.gov.uk/ukpga/1978/29/section/2">section 2</ref><ref eId="c00004" href="https://www.legislation.gov.uk/ukpga/1978/29/section/2">(1)</ref><ref eId="c00005" href="https://www.legislation.gov.uk/ukpga/1978/29/section/2">(a)</ref> of the <ref eId="c00006" href="https://www.legislation.gov.uk/ukpga/1978/29/contents">National Health Service (Scotland) Act 1978</ref> whose area includes, or is the same as, the area of the local authority,</p></content></level><level class="para1" eId="section-5-16-d"><num>(d)</num><content><p>Scottish Enterprise,</p></content></level><level class="para1" eId="section-5-16-e"><num>(e)</num><content><p>South of Scotland Enterprise where all or part of the area of the local authority is within the South of Scotland as defined by <ref eId="c00007" href="https://www.legislation.gov.uk/asp/2019/9/section/21">section 21</ref> of the <ref eId="c00008" href="https://www.legislation.gov.uk/asp/2019/9/contents">South of Scotland Enterprise Act 2019</ref>,</p></content></level><level class="para1" eId="section-5-16-f"><num>(f)</num><content><p>Highlands and Islands Enterprise where the area within which, or in relation to which, it exercises functions in accordance with <ref eId="c00009" href="https://www.legislation.gov.uk/ukpga/1990/35/section/21">section 21</ref><ref eId="c00010" href="https://www.legislation.gov.uk/ukpga/1990/35/section/21">(1)</ref> of the <ref eId="c00011" href="https://www.legislation.gov.uk/ukpga/1990/35/contents">Enterprise and New Towns (Scotland) Act 1990</ref> includes the whole or part of the area of the local authority,</p></content></level><level class="para1" eId="section-5-16-g"><num>(g)</num><content><p>the Skills Development Scotland Co. Limited,</p></content></level><level class="para1" eId="section-5-16-h"><num>(h)</num><content><p>a regional Transport Partnership established by virtue of <ref eId="c00012" href="https://www.legislation.gov.uk/asp/2005/12/section/1">section 1</ref><ref eId="c00013" href="https://www.legislation.gov.uk/asp/2005/12/section/1">(1)</ref><ref eId="c00014" href="https://www.legislation.gov.uk/asp/2005/12/section/1">(b)</ref> of the <ref eId="c00015" href="https://www.legislation.gov.uk/asp/2005/12/contents">Transport (Scotland) Act 2005</ref> whose region includes, or is the same as, the area of the local authority.</p></content></level></subsection><subsection eId="section-5-17"><num>(17)</num><intro><p>The Scottish Ministers may by regulations modify the list in <ref href="#section-5-16">subsection (16)</ref> so as to—</p></intro><level class="para1" eId="section-5-17-a"><num>(a)</num><content><p>add a person or description of person,</p></content></level><level class="para1" eId="section-5-17-b"><num>(b)</num><content><p>remove an entry listed in it,</p></content></level><level class="para1" eId="section-5-17-c"><num>(c)</num><content><p>amend an entry listed in it.</p></content></level></subsection><subsection eId="section-5-18"><num>(18)</num><content><p>Regulations under <ref href="#section-5-17">subsection (17)</ref> are subject to the affirmative procedure.</p></content></subsection></section></hcontainer></body></act></akomaNtoso>
