uk:target="true"><num>37</num><heading>Right of occupier or grazings committee to prevent damage by deer</heading><subsection eId="section-37-1"><num>(1)</num><content><p>The 1996 Act is modified as follows.</p></content></subsection><subsection eId="section-37-2"><num>(2)</num><content><p><mod>In section 5A (code of practice on deer management), in subsection (2), after paragraph (c) insert—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="asp" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><level class="para1"><num>(ca)</num><content><p>make provision about the exercise of rights under sections 26 and 26ZA (and any regulations made under section 26ZB),</p></content></level></quotedStructure><inline name="appendText">.</inline></mod></p></content></subsection><subsection eId="section-37-3"><num>(3)</num><content><p><mod>In section 17 (unlawful killing, taking and injuring of deer), after subsection (3) insert—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="asp" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><subsection><num>(4)</num><intro><p>Subject to sections 25 and 25A, any person who knowingly causes or permits another person to take or kill a deer on any land—</p></intro><level class="para1"><num>(a)</num><content><p>without permission from a person having the right to take or kill the deer, or</p></content></level><level class="para1"><num>(b)</num><content><p>in circumstances to which section 26(1) or section 26ZA(1) do not apply,</p></content></level><wrapUp><p>is guilty of an offence.</p></wrapUp></subsection><subsection><num>(5)</num><intro><p>It is a defence for a person charged with an offence under subsection (1) to show that the person reasonably believed that—</p></intro><level class="para1"><num>(a)</num><content><p>the taking or killing was permitted by a person having the right to take or kill deer on the land, or</p></content></level><level class="para1"><num>(b)</num><content><p>section 26(1) or, as the case may be, section 26ZA(1) applied to the taking or killing of the deer on the land.</p></content></level></subsection></quotedStructure><inline name="appendText">.</inline></mod></p></content></subsection><subsection eId="section-37-4"><num>(4)</num><content><p><mod>For section 26 (right of occupier in respect of deer causing damage to crops etc. on certain ground), substitute—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="asp" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><section eId="d25e157"><num>26</num><heading>Right of occupier to prevent damage by deer</heading><subsection eId="d25e161"><num>(1)</num><intro><p>An occupier of any agricultural land or woodland, or a person mentioned in <ref href="#d25e218">subsection (4)</ref> authorised in writing by the occupier, may take or kill, and sell or otherwise dispose of, any deer found on the land or woodland if the occupier has reasonable grounds to believe that the taking or killing of deer is necessary to prevent—</p></intro><level class="para1"><num>(a)</num><intro><p>damage—</p></intro><level class="para2"><num>(i)</num><content><p>to agricultural production (including any crops or human or animal foodstuffs) on the land,</p></content></level><level class="para2"><num>(ii)</num><content><p>to the woodland, or</p></content></level><level class="para2"><num>(iii)</num><content><p>whether directly or indirectly, to the natural heritage or environment generally, or</p></content></level></level><level class="para1"><num>(b)</num><content><p>injury to livestock kept on the land, whether by serious overgrazing of pastures, competing with any such livestock for supplementary feeding, or otherwise.</p></content></level></subsection><subsection><num>(2)</num><content><p>Subsection <ref href="#d25e161">(1)</ref> applies notwithstanding anything contained in any agreement between an occupier of the land or woodland and the owner.</p></content></subsection><subsection><num>(3)</num><content><p>Subsection <ref href="#d25e161">(1)</ref> does not apply during any period fixed by order under section 5(1) (taking, killing or injuring deer in close season) in relation to the sex and species of the deer concerned.</p></content></subsection><subsection eId="d25e218"><num>(4)</num><intro><p>The persons referred to in <ref href="#d25e161">subsection (1)</ref> are—</p></intro><level class="para1"><num>(a)</num><content><p>the owner of the land or woodland,</p></content></level><level class="para1" eId="d25e233"><num>(b)</num><content><p>the owner’s employees,</p></content></level><level class="para1" eId="d25e239"><num>(c)</num><content><p>the occupier’s employees, or any other person normally resident, on the land,</p></content></level><level class="para1" eId="d25e245"><num>(d)</num><content><p>any other person approved in writing by SNH as a fit and competent person to take or kill deer for the purpose referred to in <ref href="#d25e161">subsection (1)</ref>.</p></content></level></subsection><subsection><num>(5)</num><intro><p>Any authorisation given by an occupier of land to take or kill deer expires—</p></intro><level class="para1"><num>(a)</num><content><p>at the end of such period as the occupier may specify in it,</p></content></level><level class="para1"><num>(b)</num><content><p>in relation to a person mentioned in paragraphs <ref href="#d25e233">(b)</ref> or <ref href="#d25e239">(c)</ref> of <ref href="#d25e218">subsection (4)</ref>, the person ceases to be in the employment of the owner or, as the case may be, the occupier, or ceases to be normally resident on the land,</p></content></level><level class="para1"><num>(c)</num><content><p>in relation to a person mentioned in paragraph <ref href="#d25e245">(d)</ref> of that subsection, when the person ceases to be so approved, or</p></content></level><level class="para1"><num>(d)</num><content><p>if the occupier revokes it.</p></content></level></subsection></section><section eId="d25e299"><num>26ZA</num><heading>Right of grazings committee to prevent damage by deer</heading><subsection eId="d25e303"><num>(1)</num><intro><p>A person authorised in writing by a grazings committee of any particular common grazing, and who meets the condition mentioned in <ref href="#d25e345">subsection (3)</ref>, may take or kill, and sell or otherwise dispose of, any deer found on the common grazing if the committee has reasonable grounds to believe that the taking or killing of deer is necessary to prevent—</p></intro><level class="para1"><num>(a)</num><intro><p>damage—</p></intro><level class="para2"><num>(i)</num><content><p>to woodland forming part of the common grazing, or</p></content></level><level class="para2"><num>(ii)</num><content><p>whether directly or indirectly, to the natural heritage or environment generally, or</p></content></level></level><level class="para1"><num>(b)</num><content><p>injury to livestock kept on the common grazing, whether by serious overgrazing of pastures, competing with any such livestock for supplementary feeding, or otherwise.</p></content></level></subsection><subsection><num>(2)</num><content><p>Subsection <ref href="#d25e303">(1)</ref> does not apply during any period fixed by order under section 5(1) (taking, killing or injuring deer in close season) in relation to the sex and species of the deer concerned.</p></content></subsection><subsection eId="d25e345"><num>(3)</num><content><p>The condition referred to in <ref href="#d25e161">subsection (1)</ref> is that the person is approved in writing by SNH as a fit and competent person to take or kill deer for the purpose referred to in that subsection.</p></content></subsection><subsection><num>(4)</num><intro><p>Any authorisation given by a grazings committee to a person to take or kill deer expires—</p></intro><level class="para1"><num>(a)</num><content><p>at the end of such period as the committee may specify in it, or</p></content></level><level class="para1"><num>(b)</num><content><p>if the committee revokes it.</p></content></level></subsection></section><section><num>26ZB</num><heading>Further provision about exercise of rights to prevent damage by deer</heading><subsection><num>(1)</num><content><p>The Scottish Ministers may by regulations make further provision in connection with the exercise of rights under section 26 and 26ZA.</p></content></subsection><subsection><num>(2)</num><intro><p>Regulations under this section may, in particular—</p></intro><level class="para1"><num>(a)</num><content><p>require a person to take specific action (such as to give notice) before the rights may be exercised,</p></content></level><level class="para1"><num>(b)</num><intro><p>set out the consequences for failing to comply with any requirements set out in the regulations, which may include—</p></intro><level class="para2"><num>(i)</num><content><p>disapplying section 26(1) or 26ZA(1),</p></content></level><level class="para2"><num>(ii)</num><content><p>creating offences and penalties in connection with such a failure.</p></content></level></level></subsection><subsection><num>(3)</num><content><p>Before making regulations under this section, the Scottish Ministers must consult such persons as they consider represent persons likely to be interested in or affected by the regulations.</p></content></subsection><subsection><num>(4)</num><content><p>The maximum penalties which may be imposed in respect of an offence created under the regulations are, on summary conviction, a fine of level 4 on the standard scale for each deer in respect of which the offence is committed or 3 months imprisonment or both.</p></content></subsection><subsection><num>(5)</num><content><p>Regulations under this section are subject to the affirmative procedure.</p></content></subsection></section></quotedStructure><inline name="appendText">.</inline></mod></p></content></subsection><subsection eId="section-37-5"><num>(5)</num><content><p><mod>In
